Definitely the rider's fault. That also looks like a crazy road to be riding on, despite the large shoulder. I know city folk don't have a lot of options since car culture sucks, but you gotta watch out for yourself. Having to dip into a lane of fast moving traffic to avoid a broke down car is iffy-AF.
No, it's not iffy. You stop in the shoulder lane and wait until the motor vehicle lane is clear.
If it's too busy a road for it to be clear long enough to pass the obstacle, then find another route, or walk your bike around the obstacle on the right if possible. But this is a normal situation.
Most roads like this won't have a painted bike lane at all, just a narrow shoulder, and people will still ride it.
