Because the murderer was arrested right away. You need to think about your lapses in logic. Don't use Rupp's name in vain. If anything, this shores up the argument that Penny was given the benefit of the doubt partly because he was white.

Probably not. Look at the Rittenhouse trial. The court didn’t allow some of his past social media posts to be brought up (and I was all for them being kept out). Similarly here, the court probably won’t let the past arrests come into play. Even though it was obvious that Jordan was a wacko, he wasn’t carrying around his criminal history report and the marine could not officially have known he was choking a thug

Just curious: do people on here genuinely disagree with the concept of self defense, or do you just enjoy being argumentative?
When someone clearly states their intent to kill, do you really think the response should be to just say "that's nice" and then wait to see if they actually kill?
There were no threats to kill or weapons on him. But since you brought up self defense, what am I supposed to think if I see a homeless guy being choked out on the subway? Am I to assume it's a white knight saving us all from potential danger?
The guy is a marine and knows full well a chokehold is not a restraining technique, but a way to render someone unconscious. It seems Penny is the one who lost his temper waaay more than Neely and in these circumstances Neely would have been fully within his rights to act in self defense.

I don’t understand the issues here. Crazy guy in subway does what crazy people do. Marine takes him down to subdue him and to make sure he doesn’t do harm. At this point, there really isn’t much to see here. Marine is a hero. Crazy guy should be arrested/committed. Whatever it takes to make sure he’s not back on subways terrorizing. Faith or not in our system, this is what it should do and is theoretically at least designed to do. We are not a nation of vigilantes so for better or worse, need ti accept what the police and/or courts do with the guy.
But that isn’t where it stops. The marine chokes the guy to death, holding him for 15min, while subway riders do nothing to help restrain the crazy guy. From my viewpoint this is an accidental death, involuntary manslaughter and the use of excessive force. The rest of the subway should have consequences for being complicit in the man’s death.
Marine shouldn’t go to jail for long, but can’t escape some kind of punishment. Went from a hero to, not a zero, but certainly something other than a hero real quick. I feel for both the marine and the crazy guy and am pretty pissed at the other subway riders for letting this guy take the heat and not saving him from himself.

This 'guy' had 50 prior police engagements, was known to have a severe mental health issue trending toward violence. Other passengers did in fact call 911 to report his aggressive and threatening behavior. NYPD no where to be seen, nor was their a police presence at each stop as required. Took 20 plus minutes for NYPD to respond. Loss of life is to bad, however actions have consequences.

The chokehold was roughly two minutes long. Initial reports of “15 minutes” were completely exaggerated. Do not believe everything you see vomited up on HuffPo. There were nearly two dozen witnesses who independently gave statements to NYPD about the length of the chokehold and statements made shortly before it happened. Such as “I will kill every mother-f’er on this train”. Beyond the “I am hungry and thirsty” variety offered up to soften the narrative. Problem w/virtue signaling in this particular instance is the facts are not going away.
