When UCLA accepted the penalties, the NCAA had already interviewed Brosnan and all the facts had already been 100% established. The only reason Brosnan hadn't had his hearing yet was because he REFUSED to cooperate with the investigation for 4 months.
Brosnan's refusal to cooperate was detrimental to UCLA being able to move on with a new coaching staff and rebuild. Whether by accident or on purpose, Brosnan's actions and his continued delaying of the investigation were extremely harmful to UCLA even in 2024. They wanted to serve the penalties as early as possible and then move on from it.
Even if UCLA told him on his first day at UCLA that it was illegal, he was going to do it anyway. UCLA specifically told Brosnan in November that he wasn't allowed to speak with transfers, or their parents, prior to them entering the portal. Brosnan disobeyed them and continued speaking with them - throughout December and January BEFORE they entered the portal.
This case is about the clearest NCAA case you will ever see. Brosnan admits to the phone calls (which are tampering). The recruits themselves admitted Brosnan spoke about recruiting to the parents (more tampering). There was literally a picture sent to the NCAA of Brosnan speaking to a SOPHOMORE at a track meet before the permissible date of contact (NCAA violation).
