"Thus, because the Constitution does not require that the president be free from indictment, conviction or prison, it follows that a person under indictment or in prison may run for the office and may even serve as president."
"This is the prevailing legal standard that would apply to former President Trump. The fact of his indictment and potential trial is irrelevant to his qualifications for office under the Constitution."
You post has absolutely nothing to do with state laws that control voting and ballots. Sure, Trump can run. But there is no requirement for states to put anyone on their ballots if they have not complied with states laws. There are NO federal laws requiring people who run for president to be on every state ballot. Stop proving your are put of your element.
"Constitutional experts also told ABC News that previous Supreme Court rulings hold that Congress cannot add qualifications to the office of the president. In addition, a state cannot prohibit indicted or convicted felons from running for federal office."
From what the experts are saying, state electoral laws do not override the Constitution on this.
Trump was claiming these payoffs had nothing to do with the election. It was to protect Malaria dignity.
But he is on tape saying to Lawyer that they can be released from their silence payoff after the election because it won’t matter if they go public then. Oops!
He even wanted to stiff one after the election. Typical Trump
I'm not very smart but can someone explain to me how he sought to influence the 2016 election during 2017? "From August 2015 to December 2017, the Defendant orchestrated a scheme with others to influence the 2016 presidential election by identifying and purchasing negative..."

That’s when the paybacks happened and were fraudulenty coded. Trump is never a prompt payer of his debts.

got it?
did you read the report?
how could the false entries and/or lying about that money influence the election which already happened? In the DAs words he did those illegal actions in order to influence the election.

It was a scheme. The scheme covered that entire time extending after the election. Paybacks and also pressure to keep it silent after the election w Mueller. All was part of this scheme.

read the report. It’s only a dozen pages.
That is the statement of facts, not the charges. He is being charged with 34 counts of felony falsifying business records, with the misdemeanor allegedly being done in order to conceal a felony (violating NY election law, or perhaps Federal election law). But most of the misdemeanors (false records) occured after the election. Or is there another post election felony? The felony conveniently was not named today, just some felony acts.
From the actual charges
"DONALD J. TRUMP, Defendant. THE GRAND JURY OF THE COUNTY OF NEW YORK, by this indictment, accuses the defendant of the crime of FALSIFYING BUSINESS RECORDS IN THE FIRST DEGREE, in violation of Penal Law §175.10, committed as follows: The defendant, in the County of New York and elsewhere, on or about February 14, 2017, with intent to defraud and intent to commit another crime and aid and conceal the commission thereof, made and caused a false entry in the business records of an enterprise, to wit, an invoice from Michael Cohen dated February 14, 2017, marked as a record of the Donald J. Trump Revocable Trust, and kept and maintained by the Trump Organization."
"“The People of the State of New York allege that Donald J. Trump repeatedly and fraudulently falsified New York business records to conceal crimes that hid damaging information from the voting public during the 2016 presidential election,” said District Attorney Bragg."

He can run all he wants but if he wants votes in Florida he'll need to be on the ballot and he won't be if he is a convicted felon if he doesn't cure the felony as required by the state. He likely would do so so it is a moot point but if he doesn't he's not on the ballot.
It’s 34 counts where they just changed the date on each one. This is a mockery of justice. I hope Paxton or any other Republican AG indicts Hunter and the big guy if they ever step foot in a red state again
trump was paying Cohen back in several smaller payments as part of the effort to disguise it as legal fees. That's how it works -- separate counts for each item. That's how counting works.

That is true and it is also true the Federal DOJ does not allow charges to be made like that. I think they call it "stacking" or something - hiding weak charges with volume of charges.

True
this is how NY historically charges these crimes. Nothing out of the ordinary for Trump. Feds like singular charges.
If you have a problem take it up w Trump and his reluctance to pay back promptly in one lump sum.

IMNAL, but this is NY not federal, so ??? Also I'm reading reports that this could result in a sentence of years in Rikers where his buddy the trump accountant Weisselburg is living.
Even CNN is seeing the weakness here." CNN legal analyst Elie Honig notes that the DA's office will need to prove that Trump and his team falsified records with the intent of committing another crime in order for the charge to bump up from a misdemeanor to a felony. "The core conduct that is charged in this indictment is the payment of hush money. Now, payment of hush money is not a crime. It's not a federal crime. It's not a state crime," Honig explained. The DA's office is "relying on a state law that makes it, in the first instance, a misdemeanor to falsify business records. These are the repayments to Michael Cohen that were falsely logged within the Trump Organization as legal fees — when they were not legal fees. One of the complicated legal questions here is; in order to bump that up from a misdemeanor to a felony, you have to show that those records were falsified to commit some other crime. Some second crime," Honig told CNN's Anderson Cooper. The DA's office did mention federal and state campaign laws during his remarks, which Honig said, could be where more legal questions come up. Honig also highlighted how the DA's office did not say what that alleged second crime is, an issue the defense lawyers "rightly" complained about because the purpose of an indictment is to serve notice to the defendant on what they're being charged with."

conspiracy to do bad sh1t. Pecker + Cohen + trump conspiring to break election law.
As I read it he is not being charged with conspiracy he is being charged with 34 counts of falsifying business documents, most of which seemed to happen in 2017.
