Are you sure that talk was created today, and it was Fox News that created it?

I am old enough to remember the times before Clarence Thomas when nominations to the Court were largely pro forma.

Roe, in part, changed that and made SCOTUS part of the political scene in a way it largely was not before. Also Congress not writing the laws and regulations and passing that responsibility to the executive branch set up the court to rule on how the executive branch administered the law. Sometimes it is not the law itself that is an issue but how the administration enforced it or the policies that dealt with the nitty gritty.

Also, if we send more rule making to the states, it could reduce the importance of SCOTUS.

Others have stated that Mitch McConnell will hold things up. I am not exactly sure how he will do that this time around unless Manchin switches parties. THAT would be wild! I also don't think he can string this out until January 2023 either.

Biden did promise a Black woman so I do not see how he cannot follow through on that without huge backlash. It looks like a recent DC court of appeals Black woman was confirmed 53-44.

In the end Biden will replace a liberal with a liberal. McConnell is a smart guy when it comes to these things and while he might say he does not like the pick and likely votes against the pick, he would be better served to hold his ammo in case one of the "conservative seats" opens under Biden.

A few things...

1) He promised during the election to nominate a Black woman. Harris is that and more!

2) There has often been this idea of shoving a VP off to the court to get rid of them in such a way that it does not look like he jettisoned them. It would then free up Biden to select a VP that he might actually like or that he thinks could win in 2024 (if he does not run.)

I think it is just something that gets tossed out because people have to fill time.

Actually, this is a great opportunity for the Republicans to let the nominee breeze on through and give the rest of us a gift of no drama. They figure a liberal justice will replace a liberal justice either way, so it is a neutral proposition. Good for Breyer to see the writing on the wall and spare us the drama of another RBG fiasco.

I wrote something similar before seeing your response. McConnell and others can rail against the "lib" and even vote against her (going with Biden keeping his promise) while not actually being able to stop her and save that move for if one of the conservatives leaves under Biden.

Median LSAT score by race (there is a linear relationship between LSAT scores and bar exam pass rates, and attrition is significantly higher among those with an LSAT score under 150 than above):

White - 153 (5% attrition rate 1L)

Latino - 146 (9% attrition rate 1L)

Black - 142 (11% attrition rate 1L)

If you combine the Bar exam pass rates, the enrollment stats and attrition stats, the demographics of actual lawyers hitting the system today would be about 72% white, 7% Asian, 13% Hispanic, 1% Native American, and 7% Black. Thus, the construction of the supreme court as it currently exists is not all that different than one should reasonably expect (eventually, the court will likely be majority female as they started outnumbering men in law schools in 2015 and statistically get better grades than men).

Many people are saying it is a quality post. We will just have to see.

Why not Kamala Harris? She is more qualified for being a Supreme Court Justice than Vice President. Based on her approval rating nobody wants her to be vice president. This way if something happens to Joe than no one would cry oh no now look who's President. You happy S.O.B.
