The accident is, of course, totally the fault of the guide.
However if the blind fellow and guide had been on bicycles and had run into her, then the accident would have been the fault of the woman.

She was rear ended. The injuries claimed far exceed those of being run into by a runner.
My guess is the lady needs money. $50,000 demanded because she was unable to take care of her 9 year old? She wants money to cover her failure as a mother. A partially dislocated shoulder doesn't prevent you from being able to take care of a 9 year old. A partially dislocated brain would be a better reason.
She claims she was hurt so bad that she can't even do house work or play with her kid, YET she ran a 10K in 54 minutes two months after the collision! she is lying through her teeth!
she is a lawyer herself and she knows the Canadian Para Olympic committee has deep pockets and she is going after them for purely monetary gain taking advantage of an accident.
I am just surprised that she has kids? I thought a woman like this would eat her own young...
It sounds like the plaintiff is being a bit opportunistic in her law suit

Ottawa born and raised here. I've run on that stretch of path hundreds of times and sometimes it's a yard sale. Sunday mornings are usually the busiest time of the week because of the running room clubs and other clubs doing their long runs. The Canal paths are plowed in the winter unlike most (or all) of the other rec paths so sometimes runners end up getting funnelled onto those paths because it's the best place to run. Plus, if there was skating permitted on the Canal on that day, there would have been some skaters and tourists walking on that path too and some of these people are oblivious and erratic, not to mention the people wearing MP3 players. I've had skates almost hit me a couple times or so as well as other objects, and one lady once swung her purse hard into my stomach--she veered at the last minute and wasn't looking where she was going and I didn't have enough time to react. This was all on that stretch, or close to it, at this time of year. At that time of the year, there are sometimes ice patches on the path, and that stretch of the path also curves a couple of times, and sometimes one side of the path is plowed before the other, or the middle is plowed, so the best strip to run on can get pretty thin and maybe doesn't follow the curvature of the path. There are people who follow the best footing without looking around and realizing that they should be giving other people more room or should not be veering across the path.
I'm trying to recall if that was the winter they were also rebuilding part of that section of the path: it was diverted onto a temporary path made of dirt and gravel which was often a bit rough to run on.
Basically, picture a fair bit of weaving going on. It will be interesting to hear what Dunkerley's guide will have to say, but I picture someone having to make a sudden adjustment to avoid slipping. This happens. It's part of the risk of running outside during the winter.

What a skank! Suing a disabled person. And those injuries are a total fraud. I've been tackled in rugby by big Gunthers charging at a furious pace and never suffered as much as this woman.

She will have to prove damages. If she does, she deserves to be compensated. Medical bills, a little something for the time any hospitalization or rehab kept her from being 100% (in childcaring or in running for that matter).
If this had been a car accident or a bike accident, of course the person who did the rear-ending would be liable. Why should running be any different. People need to watch where the F they are going: including blind people.
rsbones you don't get it. you seem to be the type that if you break a fingernail you would sue someone about it. if you caught a cold you would sue the all of the sick people at work for not staying home and getting you sick. if a bird pooped on your car you would sue the parking lot owner, or the city that owned the street.
afterall, you are not responsible for taking care of yourself. someone else is.

You can make a case for her suing the runner and the guide, but naming all of the other runners in the group and the Ottawa Lions in the lawsuit, as well as the outrageous amount she's asking for... WTF? It seems to me that she's just out to get free money.
I was once in a situation where some lady ran a red light and T-boned my car at an intersection. My knee suffered some soft tissue damage, which kept me from most of the activities I enjoy for several weeks and was still much tighter than my other knee from the scar tissue for several years after the fact. I know that I probably could have sued her for my injuries. Hell, I could have really used the money, as I was a university student at the time, but the difference between me and the lady in this lawsuit is that I'm not an opportunistic piece of sh*t, who tries to turn every misfortune into a windfall. I don't regret not suing one bit to this day.
Too many lawyers and bureaucrats and not enough engineers and innovators is one of the main reasons why Western countries are falling behind in the World. Too many people are looking for free handouts at the cost of those who don't.

People often don't keep right or check behind--everybody has their moments. I've been passed by Dunkerley or his brother in their group a few times; I don't know them, just who they are. the group kept tightly packed and left me plenty of room, and each time it took me a 2nd glance to realize that one of them was being guided. I guess that's why I find it hard to imagine, after he's run a bunch of miles and track races, how he could run into a woman who is keeping to the right on the path unless there was something amiss with the path.
ugh, this issue has gotten under my skin big time.
I heard her child that she had in her 40's is from in vitro because no one would marry her!
