Anyone able to find the source document for this? Or know when it was enacted? The info in the Telegraph article is a bit vague.

I checked the IOC Charter and the WADA code but couldn't see this rule.

If it's a new rule it's unlikely to have retroactive effect and so Merritt shouldn't be excluded from London 2012.

The BOA have a rule like that in place, Dwain Chambers took them to court over it and was unsuccessful. I don't know anything about the IOC, but I agree, it ought to be a lifetime ban.

Here is a story from a reputable source. However, it only mentions it as coming up for a vote. Nothing in the charter that I could find. (Searched several terms).
