No. A criminal statute ecannot be implemented retroactively, and a law/rule forbidding the tents would essentially amount to a "criminal statute".

Yes definitely. Altitude tents constitute a clearly artificial method of raising EPO just like taking drugs.
In cycling, they decided to put restrictions on what type of bicycle could be used for the hour world record. All the past records which were performed on bicycles that did not conform to such regulations were erased from the record books.
The same thing could easily be done in athletics.
And, if they next decide to outlaw taking multi-vitamins? I think that they constituted an "artificial" method of raising bodily vitamins. The main reason (in my mind) for outlawing PEDs is that PEDs generally HARM the person taking them, AND it's unfair to expect someone else to have to harm themselves in order to be able to compete. Using an altitude tent won't harm anyone. The only unfair advantage is the cost, but the cost of shoes or high altitude training is prohibitive to a lot of people as well. And, on a purely realistic/logical level you can't punish someone for doing something that was legal.
Bingo. The difference between banned PEDs and supplements that everyone uses is that the banned substances are considered unsafe.
Paula Radcliffe stopped using Altitude tents in 2001.
I doubt whether Radcliffe actually ever used one of these. They don't exactly look too portable, and the amount of time she spends travelling , means she couldn't possibly use them. If she did infact she would be on the list above. I think she was at one stage but this was wishful thinking on their part and trying for free publicity.
when the wada banneds something it is only in affect from the date it is signed on paper. meaning no ones performances before then can be affected by the wada because the thing was not banned when they were competing.
I guess I better sell my condo at Mammoth. It will be banned by WADA at some point...

No, that's why Bonds will be able to keep his records as "the clear" was not banned (or even known about) at the time he broke the single season record.
