Spanish criminal courts have the same threshold as US counterparts - conviction requires certainty beyond a reasonable doubt aka 99%+ certainty. Dave Torrence himself said he was 95% certain this was illegal.
This looks like a straight forward situation of the judge thinking it likely they did it but not being able to say we are 99% sure he did it. Judge said the defence was suspicious and not compelling but there was a lack of evidence. The two charges they faced however require strong evidence of organization - it isn't enough to be in possession of the drugs you have to prove they were using it as part of a system of supply/distribution. I'm guessing they tried the bigger supply charges rather than just possession charges to try get a bigger sentence?
