Spots they weren’t entitled to and they knew they weren’t entitled to. It’s tough but why would you want to make a representative team - even a national one - through a clerical error, knowing there are other people who should have that place.

Athletes on both sides are victims. Neither side did anything wrong.
USATF intentionally failed to inform dozens of athletes of their legal rights to pursue arbitration. Yes, I will speak out and try to let athletes know their rights.
When the arbitration is through, I think athletes on both sides will probably have grounds to sue USATF for the damage caused by USATF. And I 100% support the athletes who were removed from the team, defending their spot in the current arbitration and suing USATF after the fact if they choose to.
It is gross to pit the athletes against each other, which is why I did not publish the names of the 39 athletes USATF listed as affected in the first arbitration.
The only winners here are the USATF executives making many hundreds of thousands of dollars for performing their jobs badly. In the real world, stuff like this gets people fired.

Because many of those athletes were told by people within USATF that the spots would be based off 2018-2019 marks. No, I don't think any of them knew they were not entitled to the spot. There legitimately was communication that went out saying 2018-2019 would be used.
Some athletes on the team now were repeatedly assured by paid USATF staff that their spot was fine, even after the first arbitration, in which the arbitrator said USATF was wrong.
The athletes on the team with 2018 marks have done nothing wrong, and should not feel the slightest bit guilty about fighting for their spot on the team.

Michele Lee finished 4th at CIM this year. They chose the place in front of her (3rd) and the place behind her (5th). They completely skipped Michele without ever sending her an email or a phone call.
What is the recourse?
No explanation.

I think there is a cap to the total number of athletes a country can send and it is less than the sum of all slots in all events so they have to leave some slots unused. I'm no expert, but I'm pretty sure I read that on a thread (maybe this one).

They had announced three marathoners in each race initially.
Two dropped and it was probably too late to get anyone else to accept.

3rd at CIM is going to Panams
4th at CIM never received an invite
5th at CIM is going to Panams
All 3 ran the same year the same course the same day. None of then ran faster elsewhere.
Other (civilized) countries also incorporate a current fitness standard to the selection process. And yes, this could apply to the 'thon. They don't have to actually to show fitness at 'thon distance..........but they do have to show fitness.
Why send someone based on 2018 fitness?
If a reasonable CURRENT fitness standard applied Eduardo Torres (CU) would never have gone to WC Berlin 2009.
Civilized countries that are actually trying to save money use this principle.
Judge just ruled Usatf has to use only 2019 marks for all events.
If usatf had just admitted it screwed up and went with what Max Seinfeld signed, it would have saved a lot of money and heart ache.

The arbitrator has ruled 100% in favor of those asking for it to be 2019 only.
The judge however did not order USATF to pay the $2000 fee that it cost LRC to file the arbitration. Some of you have expressed an interest in helping us out, you can do so here.

He needs to fire Duffy. Forget being scared of changing things up right before the Olympics. Ed Gorman can handle the job competently. We cannot afford another year of Duffy half-assing it.
Duffy is a smart guy. This happened because he wasn't paying attention and/or just didn't consider Pan Am team selection to be very important.
Max is the one who signed the procedures stating he had read and understood them.
How much do we pay him for this incompetence?
