The GOP Senate Majority leader refused to do his Constitutional duty and hold a hearing for Supreme Court candidate Merrick Garland. If you’re going to vote against him, then vote against him. But the Constitution says that federal court nominees from the President receive the advice and consent of the Senate and that never happened.
The GOP also said that, had Clinton been elected in 2016, they would continue to refuse to hold any hearings for potential Supreme Court vacancies, in contempt of what the Constitution says.
And what did Boogeyman Obama do about that? A recess appointment? Appointment on the basis of implied consent? He let the GOP get away with it.
Then when Democrats filibustered Gorsuch’s vote, the GOP controlled Senate just changed the rules to require a simple majority for Supreme Court appointments to get him through.
It was really inconvenient for you that Scalia died while Obama was President, wasn’t it? And really inconvenient that the Senate leadership had ever refused to hold a hearing on a Supreme Court nominee, election year or not. And it was really convenient that RBG died six weeks before Trump was voted out of office and McConnell could violate the precedent he had set four years earlier to ram another conservative judge into the court.
And after all that, Trump really wanted Pence to just reject the electors from a few states, in violation of the Constitution, in a desperate bid to send the vote back to the state delegations in the House to secure him another term.
Democrats have flouted Constitutional protections and norms numerous times throughout history. I am not so blind as to not see that.
