New York State penal code does not actually define “intent to defraud” but several rulings in NYS have defined it as:
”for the purpose of leading another into error or to disadvantage”
”an intention to deceive another person, and to induce such other person, in reliance upon such deception, to assume, create, transfer, alter or terminate a right, obligation or power”
”wronging one in his property rights by dishonest methods or schemes, and usually signifying the deprivation of something of value by trick, deceit, chicane or overreacting”
Notably, an intent to defraud does NOT require “an intent to deprive another person of money, property rights or a pecuniary interest” and does not require any “financial harm”.
In fact, simply impeding the goverment’s ability to perform its official duties is sufficient.
Nowhere in the definition of “intent to defraud” is a requirement that it’s beneficial to the one doing the defrauding.
