A German Pinscher is 30-45 pounds and they can be nasty little bsds.
If a dog rears up on his hind legs and comes at you, you have every right to defend yourself.
There's no guarantee that the leash won't snap or that the owner will lose grip.
Ok. I'll give it to you. I'll concede that dogs aren't things. One definition said "personal belongings", and I suppose I COULD argue that a pet is a personal belonging...we do OWN them after all. But, I'm willing to accept your view and say that I was wrong to call a dog a "thing". There was one defition that said a thing was a "material object without life or consciousness". That's probably the better definition.Just for fun though, in tennis you can be penalized for "racket abuse".

You are equating a dog with, say, a book. Dogs are animals, not things. You can't get arrested for "book cruelty," but you can get get arrested for animal cruelty. An animal has inherent rights, and a book does not.

I also get that people connect with their dogs on different levels. One of my friends is like you. She has a dog, likes her all right, but still sees her a "just a dog." My dog is absolutely a member of my family. Sure, if I were forced to choose between her and a human member of my family I would choose the human, but asked to choose between her, and, say, a billion dollars, I'd choose my dog in a heartbeat. And before you accuse me of being one, I am not a sappy dog owner who thinks her dog is God's gift to the universe. I'm extremely strict with my dog, but she is definitely part of my family.
Also, how can a dog be on a leash but not properly restrained, as long as the leash isn't one of those flexi-leashes? The dog would be, at worst, 6 feet from the owner. So the Grandpa here, starting from > 6 feet from the owner, would have had to APPROACH the dog to kick it.
And sorry, but it's not against the law for a dog to jump repeatedly and bark on a leash. If you can't take dogs jumping and yapping leashes, please don't ever visit my city (a large city in the U.S.).

Old men walk around naked at Walgreens without flinching. Do you think they will think before kicking your dog if your dog is a nuisance?
Thanks for the info 800. Its obvious that I won't be walking past the old man's home when my I walk my dogs anymore. And as for the phone call I had with animal control, they sided with me.
recap for those who are misconstruing what exactly happened
1. I was walking my dogs which are 10 lbs and 20 lbs past the owner's house.
2. my dogs were barking at the kid, and since he was kid not only a child but alone outside I made sure to keep walking until out of that small area
3. The dogs were not within reaching distance of the kid, and were on a leash(one that retracts for my smaller 10lb dog and the other one which I further wrap my hand around, in which i did).
4. The old man heard my dogs came out yelled at me to stop(now looking back I could have avoided this, but I didn't want to just ignore the dude completely after turning back to see who was shouting for me to stop). So he walked towards me and basically told me to train my dogs. I did agree with him( all meanwhile my dog is now barking at the guy as we talk for 10 seconds or so
5. End of conversation and I'm about to walk away. He has a irritated/annoyed look...looks at my dog immediately kicks him with NO WARNING.
6. I then step in front of my dog and have now both of them behind me and basically told him to NEVER kick my dog again.
7. The guys face turns from irritated to worried/surprised when I begin to tell him off and question why he did what he did? He doesn't respond and he gradually walks away when his family comes to tell me off.
8. I tell her off when she starts cursing at me and I walk away
Look people for anyone who is still responding to this, whether it's the Mr Rodgers, Flagpole, Poor comprehension or anyone to address what many of your had posted or questioned here is again some of the stuff I had posted which is literally what happened step by step, otherwise I wouldn't had even made the phone call or bothered threatening back by calling the police, because if my dogs had harmed them I'd think they would have called the police without me offering to.
As to restate what I had said. I don't support my dogs barking at people or scaring people. I do take into consideration that a child should be protected from wild out of control dogs.
This was not the case here.
I made sure of it by avoiding being near him for those 5 or so seconds as I walked past their home. My dog in no way was a present danger to to kid or the old man while i held him on my leash. Not that the old man would have noticed anyways since no one was outside with the kid.
Just like in any case presented. Just to be specific I am not trying to justify whether or not my dogs are allowed to bark at people and become a nuisance to others or even to holding them to a lower value than another human's life, but as to specifically the actions of the old man.
I am going to make an assumption that many hold a prejudice for dogs when the news usually presents wild out of control vicious dog attacks on people. Which I tend to hold too I must admit. When I see a pitbull/rotweiler or just a large dog in general and the owner is small, I'll usually run an extra 10 feet around/away them.
This again is not the case.
My dog presented no possible harm to anyone in that moment. He decided to come and confront me, wasn't happy that my dog was now barking at him and kicked him. My dog's were on a leash under my control.
I just don't understand people's justifications.
And to Rodger's and any other pseudonyms you've taken on. Objectively* justify why the old man should not be held responsible for his actions had he fatally injured or permanently injured my dog with the information present.
When I phoned the rep I had asked him the question I originally posted and he sided with me since I had him on a leash. Even told me that I should have called the police when it happened and to go back and get the unit number to send someone over.

Your dogs acted in a threatening manner toward a young child and an old man, so one of your dogs took one in the chops. You got off lucky. Give it up.
The old man was wrong to kick the dog. It was not necessary. He probably did it to make sure you wouldn't come near his property with your dogs again.
Unless the dog was jumping on him, and then, he should push it off really, no need to kick it. If it bites him or goes to bite him he can boot it in the head, that's fair enough.
What type of dogs are your two dogs?
He got the outcome he desired and didn't suffer any consequences.Sounds like he won.

I don't know if the man who kicked your dog was justified or not, having only your side of the story. But you were definitely in the wrong for being too ignorant to train your dogs to behave properly in public; for taking ill-behaved dogs out in public; and for thinking that someone should allow himself to be threatened or attacked by a dog without responding accordingly.
