“State” is a generic term for government including the federal government. Supremacy clauses reasonably address any conflicts down the hierarchy.

That said, it is clear at least based on today’s polarized environment, that different states’ peoples would have strong and different preferences, so the federal government is unlikely to define life for all states.

Your reading comprehension challenge is deluding you right now. I already acknowledged the three-fifths compromise. There is nothing in 1778 to say black people or women were not persons. Persons were entitled to liberty and happiness. The constitution doesn’t discuss slaves or slavery explicitly.

If you are saying the founders were tolerant of slavery and slavery placed a low ceiling on liberty and pursuit of happiness, you are agreeing with me.

Sure, you don’t need to agree. But I would argue that pregnancy is entirely normal as the overwhelming majority of women choose to go through it in life. It has a definable cost, like to throw an admittedly somewhat arbitrary example, 4.5 months of income to the unwanting mother. The rest of the effects on the body are normal, not an oppression. If it were, practically every woman wouldn’t (normally) also delight in the prospect of going through that pain.

I don’t think the fact that pregnancy is “normal” takes away from the fact that it’s an extremely negative experience. We are biologically committed to reproduction so of course we do it anyway, but that doesn’t make it not awful. I think women should always have a chance to opt out. I don’t think irreversible and often damaging changes to your body is a cost that can be defined in US Dollars. I don’t think you know how many women dread the pregnancy portion of motherhood. It’s a lot, maybe the majority. If only there were some sort of way we could poll a groups opinion about this hm….

It does. Article I, Section 9, Clause 1 is about the slave trade. Article IV, Section 2, Clause 3 is the “Fugitive Slave Clause.”

James Madison wrote the Constitution and owned slaves his whole adult life. He saw slavery expanding westward with the growing US and did not consider the protections of the Constitution applying to Black people.

Expecting an 18th century slave owner to just abandon the economic system he was born into overnight is absurd.

I should add that Madison was more concerned about the unsightliness of slavery than the evil reality of it and never believed that free Black people would fully integrate into American society.

Slaves are cheaper than salaried workers. Salaried workers' offspring also don't automatically become more free labor for their employer.
