Putting that forward bespeaks an ignorance of 63(12), which is the key statute here and establishes the "victim" and "complainant" and "injury."
The trier of fact (the judge) has already ruled that the financial statements were false and misleading and IMO the lawyers should just be focused on minimizing the punishment that the judge will levy on DJT et al., and not on relitigating liability.
