I suspect that you have never represented a client before the government on tax issues. I have. They may yet ding him on tax fraud, they may just ding him on substantial underpayment, they my ding him on nothing. But you can be sure of one thing, if the government goes after the service providers and Trump jointly, the service providers aren't going to be willing to take a fall for Trump. In my experience such cases often result in disclosure of memos to the file saying the client has been warned that the position he wants to take is disallowed, but he insists that it be taken anyway. Of course, Trump would deny giving that order, and the Court would decide whom to believe. Other times the issue is that the client doesn't give full and accurate information to the people preparing the tax returns.
