There's a third option: That the US had created a precedent whereby it is very difficult to hold their top political leadership, and presidents in particular, to legal account. When it comes to war crimes, for instance, the US has deemed it a logical impossibility for any senior leader to be guilty, even in the face of incontrovertible evidence.
This precedent creates a real conundrum when you have a senior leader with as little regard for legality as Trump. I mean, all presidents, and many senior political and military leaders, have pushed this license for impunity to one degree or another. But Trump, being literal-minded to point of absurdity (e.g. "Obama IS the founder of ISIS"), took it too an unprecedented level, putting his political opponents in the extremely awkward position of either going after him virtually the day he took office, and thus looking like they were attempting to apply a double standard vis presidents, not to mention thwarting the will of the electorate, or else letting him run amok. Eventually, they drew some boundaries and began to go after him. It's this that has created the appearance that he is either being uniquely persecuted by a "deep state" or is a criminal mastermind, neither of which is true. He has simply pressed very hard against one of the fault lines of US politics.
So, the problem today is both Trump AND American exceptionalism when it comes to the impunity it has traditionally granted its senior leadership. As, e.g., Obama's unwillingness to pursue the Bush administration over obvious war crimes related to the Iraq invasion shows, Americans tend to prefer bi-partisan political stability to justice and the rule of law when the two are in conflict. Trump knew this and pushed its limits past the breaking point. And he is still pushing, even while out of office. Hence: the current crisis in US politics.
