I mean, personally, I'd love to see him thrown in jail because he is a con man but, that said, there is a very large segment of the population who does not believe that and might not react well to him being prosecuted. I don't think you will be able to convince the 44% who love the guy that he is a criminal. But that's just my opinion...
If you think he should not be prosecuted just because it would not be a "popular" decision, then you are indeed claiming he is above the law. Criminal justice is not a popularity contest. Deciding not to prosecute anyone because it won't be popular is almost as bad as deciding to prosecute someone because it will be popular.
Biden has said he will not intervene in DOJ's decision one way or the other. I hope he will keep his words and let the career prosecutors decide what to do. Not prosecuting Trump for political consideration would establish a horrible precedent for future presidents. They will feel emboldened to commit any crime while in office if they believe they will have lifetime immunity after leading the office.
One more thing. "Playing nice" would not work with the current GOP or the Trumpers. Moscow Mitch is already threatening to sit on Biden's cabinet nominations. So get ready to see every federal department to be headed by "acting secretary" for at least two years. We need to speak in the only language they understand.
