I’m not sure all legal scholars would say the SC mostly produces good decisions. They are slow AF, often refuse to get involved in critical issues in fear of tarnishing their reputation, and of course there isn’t even some objective incentive model for justices to do the right thing.

As for your Clarence Thomas scenario, I wouldn’t be surprised if he is offered some serious dough or other incentive (discretely of course) to retire early. If this happened Dems would have clear motivation and need to restructure the SC.

NO indication of any co-morbidities, including obesity. Just 28 years old.

I'm with Alan and Aqip on the overreaction on both sides to an available SCJ seat.

The Dems would be best served to just, barring a Q-Anon nominee, move the appointee through because if they don't they run the risk of making this the issue for the election which is exactly what Trump would want because it takes attention away from his complete failures.

On the flip side, it can be easily argued that the massive pushback with Kavanaugh helped yield the massive number of 2018 wins.

Trump is under no obligation to abide by RBG’s supposed dying wish to have “her” seat unfilled until after the election. The seat is vacated. It does not belong to anyone but the person appointed to sit on it by the Senate and the President

"Dying wishes" do not supersede the Constitution.

The reason the SCOTUS is slow AF is because there are too many cases and not enough justices. I like the idea posted the other day of adding SCOTUS justices and slitting the work load. There might 11 or 13, even 15, justices but only 9 are assigned to work and rule on a case. Now *this* would put some several conservative's politician's knickers in a death twist.

DJT is already looking at the possibility of prison time for other stuff (like the felonies committed by his co-conspirator Michael Cohen, who went to prison for them). Difficult to see why Trump would court more time in stir.
