A leaked draft with 5 republican votes means this is final. Republicans are going to get to own this political decision from now until November. Democrats will be running on expanding the court to rescind this political ruling.
Ruth Bader Ginsburg thought the logic behind Roe was flawed and thought something like this was better handled through the legislative branch with some court input.
Roe did more to politicize the court. It became a litmus test on both sides. Now this goes to the legislatures to be hashed out either state by state or in Congress. I do not see Congress doing much since the Senate has in place the filibuster. If the GOP takes the Senate in January 2023 I bet the Democrats will switch to loving the filibuster again.
Casual observers of the Supreme Court who came to the Law School to hear Justice Ruth Bader Ginsburg speak about Roe v. Wade likely expected a simple message from the longtime defender of reproductive and women’s rights: Roe...
You have a second rate mind. This is not over and in the end there are no winners here. You want babies to be born but you don’t care about them at all after that.
questions for abortion supporters in this thread.
at what point in a pregnancy is abortion WRONG and why?
Is 1 milisecond before it exits the birth canal and is born ok?
while in the birth canal?
right before labor pains?
whats your standard?
If the child is born 3 months premature and I intended on getting a late term abortion but couldn't perform in time can I "abort" the child during the delivery?
95% of abortions happen before 15 weeks. Roe allowed for bans after the point of viability, which has legally been defined as 20 weeks, with extremely limited exceptions (health of mother). So your questions are completely pointless this discussion. But thanks for playing a game you know nothing about.
Forced pregnancy... The US continues its desxent away from the first world.
Why not introduce legislation that criminalise men leaving their children and paying no child support to balance this out? Its all about a small group controlling women.
An "activist judge" (justice in this case) must be one who doesn't decide an issue your way.
I do hope the justices take action and identify the "activist" clerk or other public employee who "leaked" (perhaps sold?) the draft, fire that person's ass, and prevent them from ever practicing law or working for the government on the grounds that they are untrustworthy.
It is unauthorized disclosure of classified information and needs to prosecuted to the fullest extent of the law.
This is not classified. There was no law broken. Now the person who leaked it could be (and should be IMO) fired. Maybe even disbarred for unethical behavior, but no law was broken.
MSM headline: If abortion is banned, gay marriage could go next.
As if gay marriage is as important as life and death!
I’d say it may be more important so there are more loving families ready and eager to adopt all these babies… but I’m gonna go out on a limb and say you don’t support that either.
If you need my kidney to live, am I mandated to give it to you?
This decision has nothing to do with rights of the unborn. It’s about to sticking it to “loose” women, specifically the ones without the resources to go somewhere to have this done safely when this ruling becomes official.
I love how the pro-abortion argument always boils down to "we should be able to kill babies because they're an inconvenience to us." That's what "they don't want to" really means, and I'm glad you're revealing the motivation behind pro-choice. If it were just about protecting victims of rape and incest (which is a complete red herring argument on the part of pro-abortionists) then the pro-abortion side would be against 98.5% of abortions, but they're not. They're fighting for their right to live hedonistic lifestyles with no consequences because their lives are so sad and meaningless they couldn't imagine life without getting drunk and f*cking random strangers. It's so important to them that they're willing to kill children to do it. Really disgusting stuff.
Do you get to have my kidney if you need it? It’s a simple question.
I find it scary how many people I know personally and online who call themselves libertarians are celebrating this whole overturning of Roe v Wade. If you call yourself a libertarian but support bans like this of any kind at the federal, state, or local level, then you aren't a libertarian. This goes for firearms, abortion, weed, sex work, businesses choosing not to sell to certain groups, etc.
Libertarians are in favor of government policies that protects its people from (even ones not born yet) - it's why we are in favor of state-run police and military. You're confusing libertarians with anarchists. What was your plan with this post, though? Did you picture a bunch of libertarians reading it and going "Oh that's right, I'm Libertarian I'm not allowed to oppose anti-abortion laws. Thanks barkingsealion, I'll change my attitude now!"
Alabama is the most recent state to pass newly restrictive anti-abortion laws in 2019, following Iowa, Kentucky, Mississippi, and Ohio. Abortion remains legal at the federal level, so it is likely that as the new state laws a...

Better question is if you get your mothers kidney whenever you need it.

My pansexual queer 3-year-old child of color, Pebble Solomon Haworth, just read the Politico SCOTUS leak, looked up at me and asked, through tears, “non-birthing parent, why would Ron DeSantis do this?”

I tried to follow the gay marriage being next argument. Apparently it had something to do with Alito referencing Obergfell. A big difference IIRC is that gay marriage was decided at least in part on 14th amendment grounds.
Also, I don't really hear much interest from folks on rolling back gay marriage. Although I do recall people saying that things would be awful if they are allowed to get married---and then we got Trump so maybe they were right on that.
