It’s been quite a ride for Robert Racky. Armed only with a few lawn chairs, the now 77-year-old businessman literally invented the Wrigleyville rooftop business that lets Cubs fans watch home games from the rooftops of homes along Waveland and Sheffield Avenues. Born eleven days after the Japanese bombed Pearl Harbor, Racky has a squeaky clean criminal record, too. Well, he did until Monday. That’s when he finally decided to plead guilty after fighting a charge of felony disorderly conduct-false report for eight months. A judge sentenced him to two days in jail that he had already served. So—unlike TV star Jussie Smollett, who was charged with exactly the same felony as the rooftop king—Racky will be wrapping up his life with a criminal record in Chicago.

Racky called 911 around 8:15 a.m. on Aug. 10th last year, and told an operator that he had been carjacked, his wallet had been taken, and that he was lying on the ground in the 1000 block of West Byron, according to court records. When officers arrived, Racky was lying on the hood of a 2005 Chevy Cobalt that had a Chicago Department of Revenue boot on the front driver’s side tire, police said. The car was registered to his company.

Racky immediately admitted that he had not been carjacked, explaining, “That’s what I told [911] to get you guys over here.” Racky was immediately arrested.

There were some clear differences between Smollett’s allegedly fake hate crime claim and Racky’s case. Racky immediately admitted to police that his report was false.

The police investigation of Racky’s claim lasted less than ten minutes. The Smollett investigation took weeks and cost the city over $130,000 in police overtime alone.

Practically no one ever heard of Racky’s false claim. Smollett and his “close associates” leaked his purported attack story to the Hollywood media and then fanned the flames of hate while the national spotlight shined on Chicago.

On the other hand, Smollett had a criminal history of providing false information to police in California, while Racky had never been convicted of any crime.

A lawyer seeking the appointment of a special prosecutor to investigate the handling of the Jussie Smollett prosecution subpoenaed Cook County State’s Attorney Kim Foxx and her top deputy Friday to appear at the first court hearing on the matter.

Sheila O’Brien, a former appellate judge, also filed a “notice to appear” in an attempt to get Smollett to attend the hearing Thursday as well.

Court documents show that O’Brien requested that Foxx and her top deputy, Joseph Magats, as well as Smollett produce their original files and documents on the case to ensure “that they have not been altered or destroyed.”

We got Kellyanne out in Washington D.C. on Sunday, and our photog asked about the President taking aim at Jussie and ripping him as a "3rd rate actor" during a Wisconsin rally.

Kellyanne says Trump is just echoing what Foxx said about Jussie when Foxx referred to Smollett as a "washed up celeb" in unearthed text messages.

... saying there are lots of people in Chicago -- powerful ones too -- who are on Trump's side when it comes to Jussie and the alleged attack.

Kellyanne says Trump supporters should still be outraged over the whole case, and she hopes justice eventually comes for Jussie.

A former Cook County assistant state’s attorney this morning withdrew his request for a special prosecutor to investigate the State’s Attorney’s handling of the Jussie Smollett case.

Saani Mohammed filed the request for a special prosecutor on April 4th, saying that the Smollett case was “plagued with irregularity.”

But this morning, Mohammed appeared briefly before Judge LeRoy Martin Jr., the presiding judge of the Criminal Division, to withdraw that petition. No written motion was in the court file this afternoon. Mohammed did not immediately respond to an emailed request for comment. Martin approved the motion to withdraw.

One day after Mohammed’s case was filed, former Illinois Appellate Court Judge Sheila O’Brien filed her own motion seeking a special prosecutor to look into the Smollett matter.

Both petitions asked for a special prosecutor to look into the conduct of Cook County State’s Attorney Kim Foxx and her underlings. Mohammed and O’Brien both wanted the special prosecutor to consider recharging Smollett with faking the hate crime.

O’Brien’s petition will be before Martin again on Thursday. The former judge has subpoenaed Foxx and Joseph Magats, the top deputy who took over the Smollett case when Foxx “colloquially” recused herself, to appear at the hearing. O'Brien wants them to produce the criminal case’s original documents to ensure “that they have not been altered or destroyed and will not be destroyed throughout this case.”

Smollett has also been asked to appear on Thursday.

Fox just issued the following statement ... "By mutual agreement, the studio has negotiated an extension to Jussie Smollett's option for season 6, but at this time there are no plans for the character of Jamal to return to 'Empire.'"

Here's the loose end ... by picking up/extending Jussie's option, it would seem they have to pay him something per the contract. After all, he couldn't really accept another gig if he could be called back to "Empire." So, is Jussie getting paid for not working on the show?

Smollett’s rep released a statement as well, saying, “We’ve been told Jussie will not be on ‘Empire’ in the beginning of the season but he appreciates they have extended his contract to keep Jamal’s future open. Most importantly he is grateful to Fox and ‘Empire’ leadership, cast, crew and fans for their unwavering support.”

"Empire" costars aren't satisfied with Fox's plan to keep the actor's character off the upcoming season and are lobbying network execs to bring him back full-time.

Sources on the show tell us cast members -- including Taraji P. Henson and Terrence Howard -- feel Jussie deserves a fair shake, and that should include a full return to the show. Just last week, Fox announced Jussie got an extension through season 6, but also ... it had no plans to bring his character back to the show.

Our sources say as soon as the announcement was made, Jussie's costars got busy contacting "Empire" brass and pushing for his return.

As for why ... we're told the cast feels Jussie's character was an incredibly important part of the show, and they don't feel his return will hurt ratings. In one of the final episodes of season 5, Jussie's character, Jamal, got married in the first gay, black wedding on primetime TV. We got Jussie out just before the episode aired, and asked how he was feeling. He said, "Pride."

A Cook County judge said Friday that he has decided to let another judge rule on whether a special prosecutor should be appointed to investigate the abrupt dismissal of charges against “Empire” actor Jussie Smollett by State’s Attorney Kim Foxx’s office.
