I can't believe there isn't a lot of talk about this.

Why can’t the industry “go back to the old system?” Trump asked a room of astonished and stoic faces. “I’d like to go exactly back to what we had and ram it through a court.”
In fact, Trump plans to attempt to do just that, he said during the 100-minute college sports roundtable event that left many in the room a bit mystified and those watching from afar somewhat stunned.
While disregarding and disparaging court decisions that have opened a path for athlete compensation, Trump announced plans to release a second executive order — this one “more comprehensive,” he said — that is intended, it appears, to reimplement unlawful policies of the pre-NIL era.
The executive order will be strong enough in its language that Trump expects it to invoke legal challenges.

We will get sued. That's the only thing I know for sure."

These colleges see their students and athletes as slaves. They won't admit that openly, but based on how they're treated and used for profit, its a toxic dynamic. NIL merely brought some semblance of respectability to the efforts of student athletes.
What I find amazing is that the Republican Party on paper values minimal government interference, yet somehow their president is the most brazen facilitator of government in people’s lives in history. He activated the national guard against American citizens on home soil, he had ICE arrest people without warrants or probable cause in workplaces like Home Depot, he launches wars without Congressional approval, he is trying to require unrealistic ID requirements to simply vote, and now he and his cronies cannot even just leave the NCAA and student athletes alone and let them figure things out for themselves. Trump is the antithesis of democracy; the complete opposite of the decades old laisse faire mentality of his own party.

Yeah, it’s difficult to see this as anything but a massive overstep by the federal government simply because they don’t like how something works. Why would the NCAA need an executive order to regulate its practices? The NCAA, the athletes, and the NIL sponsors are totally capable of coming to an arrangement without the federal government baring down on their necks. College sports are not even something necessary for survival such as agriculture and energy, industries which may arguably need regulation occasionally. College sports are an entertainment consumer market which should be left to supply and demand economics only with no intervention from the federal government whatsoever. This is so insane that it makes you wonder if the proposal is just this week’s distraction from the Epstein files. Next week it will be the administration banning Canadians from the country and the week after that they will claim we are being invaded by aliens from outer space. Anything to divert from the Epstein files.
The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States; he may require the Opinion, in writing, of the principal Officer in each of the executive Departments, upon any Subject relating to the Duties of their respective Offices, and he shall have Power to grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment, and he shall determine whether Compensation shall be paid to Athletes that compete in the Pastime of Foot Ball for Colleges and Universities.
a real, free markets republican should be fine with eliminating the transfer cooling off period and allowing colleges to find ways to compensate their athletes. free market for your services every year.
this feels less like actual politics, and more like he wants to appoint himself unelected head of NCAA, and do the opposite of whatever they were doing yesterday. hence he's against NIL and probably wants transfer cooling off back.
i am on the fence on NIL -- i liked amateurism but also grew up poor and could have used any financial help. but i thought getting rid of "sit a year" was a positive without anyone getting paid. that rule played a role in me deciding not to transfer despite not liking my soccer coach. i didn't want to sit a year to resolve an issue caused by a broadly disliked coach, and wasn't eager to take on a 5th year of undergrad expense to offset that -- even though it would have lightened my course loads.
you give an inch, he takes a mile. he comes up with some dated DEI/affirmative action beef with your school, threatens a lawsuit, takes away unrelated research funding, then wants you to sign some contract where the feds get to dictate 20 other things to your school.
i see this that way. "trans" or the changes in who is winning football will be the lever into controlling dozens of other things.
as someone who got a yellow card in a game with CMS for cussing at myself after skimming a shot off the top of the bar, because NCAA decided that year they were cracking down on cussing, which stopped soon after, and never happened any other year, i am not eager for a bunch of passing political or moral nonsense to come in. what next, prayer meetings on top of the anthem?
nowhere in the constitution does he get the power to run college sports by fiat (to be fair, that sort of thing wouldn't exist for another 100 years-ish), or really to run government by EO
there was already a lawsuit with a settlement based on ideas of what the constitution requires, arguing it violated freedom of contract and antitrust to not let them move freely each season or make a buck. does he think this is coming out different a second time through?
to me the real emerging eligibility issue that needs to get fixed is players getting back eligibility when they turned pro, got signed/drafted, cashed checks, but stalled out in the minors. pro is pro. that includes the decades of failed minor league baseball players who have been allowed to come back and play another sport, eg, football. but it's turning into you go play G-league pro hoops then come back saying, "but i never made the NBA." G-league is still pro.

The NCAA members schools take federal dollars and engage in interstate commerce.
Interestingly, Muslims pray the same prayer five times a day, only variation is the number of times they repeat it during the prayer, and whether it can be recited in the head rather than aloud.

the shorter, less political version is he's a f*cking "tourist" and i don't want tourists making sports governance decisions. there's what the problems are to people who actually competed, or have been involved in it for years, and then there's political winds or someone who walks by and is like "how did that happen." i want people running this who are involved long term, invested in outcomes and what's best for everyone.

commerce clause would at best make it a CONGRESSIONAL concern. the power to regulate interstate commerce you are mentioning, is listed under congress and not the executive.
and even if you wanted to delegate that out, congress hasn't passed a law saying the legislature is exercising its power over college sports, then delegating how exactly to do so to the president, with instructions.

You ignored the part about taking federal dollars.
