If they have a micropenis, they often have hypospadias too - and the because the urethral opening is typically between the base of the micropenis and the flattened scrotum, it gets mistaken for a female urethral opening.
Some individuals with this DSD have a shallow blind pouch, indentation or "dimple" just a fraction of an inch deep growing inward in the groin, which the urethra opens into and empties out of. This feature might get mistaken for a vaginal opening by someone who's not well versed about what a human vagina is; isn't familiar with what a vagina looks like, feels like and how it functions; and doesn't know that in females the vaginal opening and urethral opening are two separate structures.

FFS, please stop with the BS. The primary reproductive organs in humans and other animals are the gonads - testes in males, ovaries in females - because those are the organs that gametes (reproductive cells) come from.
Individuals with Semenya's DSD - XY 5-ARD - develop totally normal male gonads when they are embryos/fetuses. The only male reproductive organs they don't develop totally normal versions of are the penis and prostate gland.
From the time they first grow their testes as fetuses and throughout the rest of their lives, the male gonads of persons with XY 5-ARD function normally in terms of producing massive amounts of testosterone at the expected times and in terms of producing anti-Mullerian hormone necessary to make their Mullerian structures disappear prior to birth. Just like other more ordinary blokes.
Depending on where in the body the their testes are located, when persons with XY 5-ARD grow up and start going through male puberty of adolescence, they often can produce viable sperm too. But due to not having a normal penis and having a prostate gland that's underdeveloped and doesn't produce normal amounts or quality of seminal fluid, these individuals have trouble getting their sperm out of their testes and in close proximity to a Fallopian tube where there might be an egg to fertilize. However, with medical assistance to retrieve the sperm from their testes and place the sperm inside a female partner using a pipette or similar instrument, or through IVF, many individuals with XY 5-ARD can father children.
But no penis, so reproductive organs are not developed and are ambiguous.

I believe I've read close to everything that's ever been published in the scientific and medical literature in English about XY 5-ARD in the past 50 years since the condition was first described in detail. I've never come across a single case of someone with XY 5-ARD who did not develop testes.

I doubt the Supreme Court will address an issue that affects such a tiny population of people. The NCAA director said that he’s aware of 10 transgender athletes. At the HS level, the issue is resolving itself. Theirs is so much hostility towards those athletes that fewer and fewer will want to compete. At the professional level, the only athlete that competed at the highest level, was Renee Richards.

It's a good example of how a lot of people had very strong feelings on a subject based on a visceral gut reaction, only to be completely relaxed on the matter when the media storm ended and gay couples became more visible.

What is the point of mentioning reproductive organs at birth, if, at birth, there are people who don't develop typically?
How do we know what is supposed to be typical for that baby, to judge them as "Atypical"? It's based on whether it's a male or a female, to know what would be "normal", and that's how we judge it is "a-typical". They are not "between sexes" or "both sexes" they are still either male or female. Also, if a person with DSD is going to get fertility tested, they still with either check sperm or egg. We know fertility Doctors would not be looking for eggs in Caster Semenya, or other "male" type DSD's. Intersex is a misnomer and is not used anymore.
