My take on this is that Salazar was the sleezeball we know him to be and Cain was a really immature person. The two hated each other. One is a known control freak and the other is a privileged child that probably wasn't told no enough. I suspect Mary did a bit too much exaggerating and lacked cohesive evidence and timelines. I also suspect Salazar was a whackadoodle dude who was wildly unprepared to live with Cain and treated her like he treated many—like a dick. I don't condone Salazar's behavior since he was the adult here. Just my 2¢.
^ 100% this.
So funny to me how so many people take the extreme sides on this - more than one thing can be true in the same instance. Salazar being a total psycho isn't dependant on Cain being an angel and vice versa.
Not everyone is cut out to be a professional track and field athlete - it's about as difficult a professional sports undertaking as possible. So many nations competing, so many athletes from so many walks of life, by in large (especially for a distance runner) it's a tough and lonely existence. Cain had a (sadly) very typical career path - a great age-grade athlete that simply couldn't adjust to the realities of going from being the biggest fish in a small pond to being one of many small fish in a big pond. Guys like Salazar are not the types of people that are very understanding of this. This bizarre inflation of their own careers and abilities and they hold others to their standards - in his case winning at all costs no compromises. In the end Cain most likely crumbled under the weight of most probably her own vast expectations and Salazars behaviour simply became the obvious and convenient scapegoat. Again as you said - I have no doubt he treated her like a dick, and that was probably pretty similar to the way he treated all his athletes. Is that multimillion dollar lawsuit worthy? From the way the case had gone so far, doesn't seem so.
And why a settlement? I mean come on it's obvious right? These cases cost both parties a lot of money each and every minute they are being worked. At some point for an entity like Nike, their time is worth more than arguing over if calling someone "fat" is a suable offense. My guess is both parties sat down, the realities were laid out and they probably made a token offer to just make it go away. I don't think Mary Cain made millions out of this at all.
Alberto called the Cain family and recruited Cain for NOP when she was a hs junior.
It's quite normal for a corporation to settle a lawsuit early. Corps hate the negative pr associated with trial, don't like opening access for discovery and don't like running up legal fees. The Cain case was weak, so it settled at low end of the 2 to 20 million range.
The case was weak because Mary didn't bring up any negatives til she was asked to leave, and was on record being asked to be let back in.
This will probably get a lot of down votes, but I was surprised when she filed a $20 million lawsuit against NIKE and Salazar. Seemed like a huge cash grab. She was never going to get $20 million, but she may have gotten $1-2 million. We will never know. The settlement is sealed.
If her lawyers cost $1-2million then she got $1-2million. If they cost less than that she probably didn't.
Does that mean we can finally get rid of hearing Cain complain constantly and play the blame game?? ….”I was the fastest HS runner in the country!! 😂
Actually, you will still be hearing Mary Cain say that for the next few decades any chance she gets because Mommy and Daddy Cain hired the CEO from BRR filthy rich wealth management to be the main "sponsor" of their daughter's highly publicized Atalanta/"charity work".
It appears the plaintiff's case was on the ropes according to the story. I would love to know the terms and the reasoning, but we'll never know. The chapter closes.
"Attorneys for Nike and Salazar denied the claims, including in a recent 48-page motion for summary judgement, a legal move to resolve a case in its early stages. In the motion, the attorneys argued Cain’s allegations are “demonstrably false, and even contradicted by her own testimony and public statements.” Attorneys for Nike and Salazar also said her claims were barred because of a two-year statute of limitations.
Cain’s lawyers responded to the motion in late September, but the document is not open to public inspection because of a protective order in the case. In a public filing two weeks ago, Cain’s lawyers said they needed more time to respond to the motion because discovery wasn’t complete."
And then the case settled. Very interesting. Looks like a Nike win from afar.
If it’s a Nike win- why did they settle? They did not want all of these details to come out in court. I’d they had nothing to hide they woken have kept going. They have the money to run her into the ground.
They have the money but would you rather pay a smallish settlement now and be done with it or continue litigating and spend a lot more money to eventually get to the same place in a year or two? Nike is on the defense side so litigating it costs much more than the plaintiff side. Her case was flimsy at best (a coach fat shamed a professional runner whose performance is tied to her weight? give me a break) so it was a win-win for both sides at this point to settle.

The case was pathetic. You’re a F-ing professional. Deal with it. Someone calls you fat and you don’t like it you can leave. Case closed. Time for people to grow up and stop the BS.

Exactly. She was an 18+ adult at the time. When you’re an adult you make your own decisions. Being an adult and having her parents still so involved in her life is very telling. Time to grow up. Did AlSal break any laws? If not, then go fly a kite. And I’m not a fan of AlSal and especially Nike. It’s sad because this is only a reflection of her generation.

As you should know, this case was about a lot more than Salazar calling her fat. And no, the case wasn't closed just like that: first Nike had to offer this undisclosed settlement.

High performance distance running is truly a very dirty, sexist, male chauvinist, bigoted, immoral sport just like pornography. Men and women athletes are routinely objectified their body parts and paraded just like semi-sex objects and ornaments. This is no good for the human soul and morality. I mean it's a no-brainer, I wouldn't recommend my own son or daughter to engage themselves in high-performance distance running, I would rather they toil on a farm growing potatos and corn in Thailand and lead simple life of bread and butter, sunlight and rain.
I haven't forgotten the way in which Alberto Salaazar conveniently molested Kara Goucher's private parts while giving her a massage.

I agree. Salaazar had a dangerous and insatiable male sexual streak that cannot be satisfied. My psychoanalyst self reveals this to me like an alarm bell. Salaazar and Josh Giddey are cut from the same cloth but different offences. Heck the 2 could be interchanged and you wouldn't even detect they were different. Alberto could very well have had sex with a Mary Cain a minor then while Josh could very well be America's top distance coach going around giving sexual massages to his female athletes.....
It's really pathetic that an athlete makes a conscious and educated decision which is supported by her parents, to move to Portland, Oregon to cash in on a lucrative shoe contract with the largest and most powerful shoe company on the planet and become a professional runner. Upon participating with the pro club soon realizes she made a bad decision, becomes very home sick, wants to go back home and then goes on to sue the coach and the shoe company for being "fat-shamed". Are you serious? This is absolutely egregious and shameful. You're a world class endurance athlete who makes a living dependent on your body being lean, fit, and capable to withstand the physical demands of training, and when your world class coach, whom you and your parents hired to guide and train you to be the best makes a comment regarding your weight and you cry wolf to mommy and daddy that your feelings were hurt. Why wasn't this addressed by Mary and her parents at the time it happened? Did they confront Salazar? Was he able to offer a reason and or apology for being too abrasive? I am certain Alberto wasn't trying to insult or be abusive, unfortunately Mary had already made the decision to leave the club and go home. Now at home, Mary and her parents realize they had made a bad decision to go to Portland, forfeit high school and collegiate eligibility (although they probably didn't have a problem cashing her Nike pay checks), and are embarrassed that their daughter who was the talk of the town is now considered a failure. Bitter and mad, Team Cain wants retribution and what better way to get it is through accusing her coach and the massively rich shoe company he works for of abuse. Due to being female and a minor, it seems like a slam dunk lawsuit which at worse will be settled for some cash, but this isn't working out as they thought and now Team Cain is hoping for their legal fees to be covered, let alone any settlement. Why did Mary's career go downhill upon moving home? Did another coach or club offer to work with her? I'm guessing that Mary was in the early stages of burn out and once in Portland it hit her square in the face that she was in way over her head and ultimately didn't want to be a professional runner.
You get a key element wrong here. Cain did not get homesick and go home. She was terminated from the Nike team for poor results. She actually tried quite hard to be reinstated.
The other piece often forgotten is the first 2 years of her pro career with Nike were very successful including a world jr championship at 3000, making the final of the world championship adult women's 1500, 2 us championships and a slew of records from 800 thru 3000. Some of our current stars like Purrier and Cranny have only recently eclipsed Cain's pro results, and we will see how Tuohy/Valby do at the pro level. Will either ever make a us team, win a us title, or make a world/Olympic final? The problem with Cain's career was that it was too short, not that it was unsuccessful.
Cain also never hit the market looking for a 2nd pro contract. Nike didn't take her back and then she took legal action.
Similarly, she didn't go the conventional route of hiring an agent, who then sought out the best pro contract for her. Rather she decided to go with Salazar and then hired agent to finalize the already agreed terms.
Cain clearly wanted to be a pro runner. Largely her body just exploded as she reached adulthood, and the team of athlete, coach, family, agent, sponsor didn't handle it real well.

Look you speak flippantly and shamelessly with the archetype of a sex maniac. You don't call your pubescent female athlete fat in front of sexually charged young men. You are sexualizing her by calling her fat because you intend to hint that a slimmer and more shapely girl might both attract sexual interest from the boys, and, get her a couple more PBs and medals. AlS also famously told Kara Goucher or Mary Cain that she needed to reduce her breast cup size or something like that, also in front of the boys. Commenting among the boys about a girl's most intimate sexualized parts of her body on the basis of a fitness and performance assessment or moral encouragement is downright crude, vulgar, profane and PORNOGRAPHIC!!!!
You only find such behaviors (actions and speeches) in a scene from pornography, not from the dinner table of a God-fearing, Catholic/Protestant prudish family of 4!
AIS could very well be the face of porn not the one of American distance running, to be honest right here!
The lawsuit paints a picture of Salazar as a controlling coach who often publicly berated distance runner Mary Cain about her appearance, body and weight.
As you can see, it basically claims that AS was fat shaming her, which he probably was. There is nothing about sexually assaulting her (like KG alleged) or hitting her or telling her to get on PEDs. Also, don't forget that these are just what MC had alleged and most it is nonsensical (e.g., that he caused her to be vitamin deficient). This is the very worst behavior she claims he committed and it basically a nothing burger. Was he and is a jerk? Of course. Did she and everyone else know he was a jerk when he moved out there? Of course. Is that worth $20 million? Of course not.
It may not be worth a 20million lawsuit but it's at least worth 1 quarter of that.
It is quite curious how Mary Cain didn't become a successful senior adult runner after being a fantastic teenage one. AIS had a lot to do with that, he burnt her out physically while failing to protect her from anthropogenic RFs and EMFs exposures in America. The training and workouts didn't kill her, it was the lack of a recovery protocol such as sleeping inside

Mary Cain's lawsuit is essentially because Salazar called her fat
Yep!

Let me be the jury of your take:
Beneath the veneer of all these back and forth biting each other between Mary Cain and AIS, the real dispute of the matter was centered around anthropogenic RFs and EMFs messing with their amygdala and hypothalamus. A life-giving athlete-coach relationship is founded on the ideals of platonic and altruistic love, unconditional sacrifice, patience and long-suffering and above all integrity, trust and sincerity, not fight-and-flight response which seems to be the narrative surrounding Mary and AIS.
But we all know the triggers of fight-and-flight responses are completely an anthropogenic RF and EMF interaction within the amygdala and hypothalamus, the opening of the blood-brain barrier resulting in the poisoning of the brain parts. Under such poisoning do you find that fear, hatred, deceit and betrayal occurs all too often, often uncontrollable and exponential. For one, it is both morally correct or lovingly encouraging that both AIS shouldn't have called Mary fat, and, Mary should also not have been offended and should have taken it with a pinch of salt. However, such love and encouragement simply isn't possible in a world replete with anthropogenic RFs and EMFs messing up the amygdala and hypothalamus resulting in eternal state of fight-and-flight in modern human beings living in RF and EMF cities.
Basically, if you are using the FM radio, WiFi, mobile data, or electricity 24/7 or surrounded in one, your default response and behavior whatever your religious, political or sexual affiliation is to?
F I G H T!!!
