It sucks to think that I'm gonna run in Mesa in February, and however many mules, or fast runners on borrowed bibs, or people doing someone a favour, that I'm running against as I try to qualify for Boston and do well in my age category, that a bunch of you here are all okay with them doing that.

Coachy is correct. Event orgs don't exactly advertise situations like this. There are certain people always on the lookout for an easy pay out through litigation.

Exponentially more people weasel their way into Boston doing a downhill course like Mesa than they do from bib swapping with nefarious motives.

Why? Because not one person can provide real life examples of a person running with another person's bib and then suing the race or another runner suing the race (let alone winning a suit)?

This is a victimless crime. Someone paid and someone ran. He can't sue anyone because he never completed a waiver. The race has the same liability as if someone bandited the race without a bib and got injured. There is no contract and no liability. Its a non issue. Bib transfers should always be allowed if you want all the waivers etc. But really this is just some gym bro doing a 3:00 hour marathon. No one got hurt. No one cares.

According to Matt's recent IG story, he said he completely forgot to sign up for the race because life is getting hectic, so he found a friend that wasn't going to run the race and just ran under his bib since Houston doesn't allow transfers.

He says he hates seeing negativity and if you're hurt by what he did he apologizes.

It's not as much about litigation as it is about catastrophic health emergencies and being able to locate contact and health information quickly. There are bound to be health emergencies when you've got a mass of people in one place, and insurance companies have a formula for figuring out the risk. Having one's name/address/emergency contact, etc. readily available can be extremely helpful in an emergency situation.

I mean sure, the race can point to the waiver that participants sign to try wiggle out of potential lawsuits ("hah, you signed a waiver saying we're not liable for anything"), but health emergencies are the primary concern (and litigation arising from the care & treatment situations).

Among other things, it would be unfortunate if Matt Choi collapsed with a significant medical condition and the hospital Matt was transferred to was under the faulty assumption that Matt was Eric Lee, etc. etc.

You are being downvoted but correct. The overwhelming majority of the time someone says something like “we live in a litigious society” they are not lawyers and do not have examples of case law to back up their claim. It’s just a lazy phrase for lazy thinkers

We have a poster provide information on one suit (from a non-running race btw) from 11 years ago. Do we know the outcome of the suit? And in the article the lawyer states that signing a waiver would not have mattered.

Yes, you can get sued for anything and it's common knowledge signing waivers and actually being registered would not stop someone from suing. So let's not pretend someone hopping in a race for a few miles for fun is the same as someone who is maliciously trying to get a payday.
