First, the article seems to completely miss the point of Trump v. Barbara. Like the 14th amendment, Trump v. Barbara is not about regulating immigration - but about citizenship of children born in the United States. Who would have guessed that an Associate Professor of English at the University of Houston-Downtown, with degrees from the College of Charleston and the University of South Carolina (where he wrote a dissertation on public apology - something he should be offering for this travesty of an article) isn't qualified to write about law. He certainly doesn't pass trump2028's test for citizenship - no ivy degree, no citizenship - so should be on the next plane to El Salvador.
But, the article does bring up a good point. Immigration when the 14th amendment was ratified looked different from how it looks today and therefore we shouldn't view it through a historical lens. By the same token, guns and gun violence don't look the same way they did when the second amendment was ratified, so we shouldn't look at gun rights through a historical lens. Oh wait, Thomas explicitly said in NYSRPA v. Bruen that we should ONLY consider the historical context and NOT the modern public safety benefits.
