The DC National Guard is not subject to the Posse Comitatus Act.

The National Guard can operate under 3 types of duty statuses.
1. As the militia of their state or territory.
2. As members of the federal armed forces when mobilized into federal service.
3. In a hybrid duty status under Title 32.
PCA only applies for federal service.
PCA does not apply to Title 32 status.
All the president needs to use Guard troops for Title 32 status is the consent of the governor.
There's no such requirement for the DC Guard because there is no governor.
What he's doing is 100% legal and 100% constitutional.
