The lawyers I talked to told me that this is a bad case, and since I am anti-Trump, I think this boomerangs.
1) The DA may be able to ram through a waiver of statute of limitations, but no appellate court will let this stand. It would be a disaster for the courts, as many people, many of color, would suffer if the limitations are removed. Appellate courts are conservative, even in NY.
2) To falsify records is a misdemeanor. Since the deal was in NY, this applies, but this much money to prove a misdemeanor is bad prosecution. And since Cohen falsified the records, it will be difficult to prove. Only a felony if you are covering a felony and the alleged felony (using campaign funds) is a Federal charge. Local courts have no jurisdiction. If the current DOJ doesn't touch it, it is not a case.
3) All the lawyers I talked to dislike Trump. Their question is, "this is how you want to nail him?" Their has to be a stronger case (document case). Bragg is pulling a political move. The lawyers told me that good prosecutors won't work for him. They hate losing cases.
