Tough situation indeed. Very good of her to take on the kids.

She still screwed up , still is responsible for her actions , still huge liability potential for the university.

1. Somebody upstairs had it in for Kearney and used this as an excuse to get her

2. The affair was not as consensual as Kearney would have us believe.

3. The student whom she was screwing has found God and needs to make someone pay for all of those satanic feelings she 'used' to have.

4. This was not a one-time deal and somebody running for her now dropped a dime on her. To minimize PR damage, UT and Kearney, rather than admitting that this has been a pattern, concocted this (true) story about how she was doing some student but a very long time ago.

What if they have a fight right before class and the prof then delivers a sub-par perfomance on important material? What if the student in question does work that is at best equal to you but maybe even of lesser quality, but he or she gets the nod for an on-campus scholarship or other recommendation? What if you're pulling all-nighters to get your work done, but the student banging the prof is getting by on unofficial extensions or isn't even submitting work for his or her A? There are innumerable scenarios in which it would be a problem for everyone in the course if one student is having an affair with the prof. It's an inappropriate distraction that has the potential to go seriously wrong.Now, a prof in one department dating a grad student or even an undergrad for whom he or she has no direct supervisory responsibilities, especially at a large school? I have a hard time saying that's wrong.

Furthermore, none of the scenarios you list are limited to romantic relationships between students and professors. Professors will do the things you listed based on whomever they like better, whomever they know better, perhaps the smartest or dumbest student will get extensions, or whose parents complain the loudest. So, if we should look down upon romantic relationships between students and professors then we should look down on any type of relationship between them. Perhaps we should not even let the professors even SEE the students.

None of those things are that big of a deal. If you're doing quality work in your classes, then you will not be affected. If you answer 100% of the questions right on the test, they can't give you any less than a 100.

What have the Texas women done lately? It seems most of the best recruits are going to A&M. Sounds like she has been a major vindictive beotch for a long time. And why was she getting a raise? She must have been the highest paid track coach in America already.

I'm sure the University will have to pay her off somehow just so she'll go away. She's already crying discrimination, gender bias, boo hoo look what I did bla bla bla.

One strange thing is Major Applewhite former QB got caught bonking a student trainer several years ago. Hadn't heard how he got out of that yet. Now the offensive cord.

I'd say we have a different view of what's involved in a college education. But if all you're interested in is getting 100 questions correct on the test, then I think you'll be fine. And while I agree that none of the scenarios I proposed need necessarily be related to romantic relationships, need we allow another possibility for distraction between a prof and his or her students?

The illicit relationship was the same year as the car accident, 2002. Why has Kearny hired a lawyer if she has admitted the affair, wrongdoing, and resigned? She might want to walk away from this, especially if the woman she had the affair with is not a lesbian. I imagine that if the student/athlete was not a lesbian and was coerced by Kearny into the sexual relationship, she would have a case against the university. Ten years of emotional torture and guilt from an non-consensual homosexual sexual relationship forced upon a student/athlete by a coach could turn into a costly legal case for the university. If the athlete in question was involved in any way with the car accident - on the phone with the driver, part of an argument while driving, meeting the group, etc - this is going to be a big mess. We are talking about two deaths here.

You're right. This is probably going to get bad - really bad- before long. If she were smart, she would have invested that huge salary and be able, now, to coast into retirement. Unfortunately, Bev Kearney doesn't sound like she's blessed with an abundance of brains.

I dunno, if it was a few months with one athlete some 10 years ago you'd think they'd let it go unless there is a vendetta of some sort. If there was a string of relationships over that time, yeah, that seems like grounds for dismissal.

My guess is she pissed off the wrong people and someone did some digging and found out who the athlete was and that person fessed up to it.

(A) causes the penetration of the anus or sexual organ of another person by any means, without that person's consent;

(B) causes the penetration of the mouth of another person by the sexual organ of the actor, without that person's consent; or

(C) causes the sexual organ of another person, without that person's consent, to contact or penetrate the mouth, anus, or sexual organ of another person, including the actor; or

(2) intentionally or knowingly:

(A) causes the penetration of the anus or sexual organ of a child by any means;

(B) causes the penetration of the mouth of a child by the sexual organ of the actor;

(C) causes the sexual organ of a child to contact or penetrate the mouth, anus, or sexual organ of another person, including the actor;

(D) causes the anus of a child to contact the mouth, anus, or sexual organ of another person, including the actor; or

(E) causes the mouth of a child to contact the anus or sexual organ of another person, including the actor.

(b) A sexual assault under Subsection (a)(1) is without the consent of the other person if:

(1) the actor compels the other person to submit or participate by the use of physical force or violence;

(2) the actor compels the other person to submit or participate by threatening to use force or violence against the other person, and the other person believes that the actor has the present ability to execute the threat;

(3) the other person has not consented and the actor knows the other person is unconscious or physically unable to resist;

(4) the actor knows that as a result of mental disease or defect the other person is at the time of the sexual assault incapable either of appraising the nature of the act or of resisting it;

(5) the other person has not consented and the actor knows the other person is unaware that the sexual assault is occurring;

(6) the actor has intentionally impaired the other person's power to appraise or control the other person's conduct by administering any substance without the other person's knowledge;

(7) the actor compels the other person to submit or participate by threatening to use force or violence against any person, and the other person believes that the actor has the ability to execute the threat;

(8) the actor is a public servant who coerces the other person to submit or participate;

(9) the actor is a mental health services provider or a health care services provider who causes the other person, who is a patient or former patient of the actor, to submit or participate by exploiting the other person's emotional dependency on the actor;

(10) the actor is a clergyman who causes the other person to submit or participate by exploiting the other person's emotional dependency on the clergyman in the clergyman's professional character as spiritual adviser; or

(11) the actor is an employee of a facility where the other person is a resident, unless the employee and resident are formally or informally married to each other under Chapter 2, Family Code.

(c) In this section:

(1) "Child" means a person younger than 17 years of age.

(2) "Spouse" means a person who is legally married to another.

(3) "Health care services provider" means:

(A) a physician licensed under Subtitle B, Title 3, Occupations Code;

(B) a chiropractor licensed under Chapter 201, Occupations Code;

(C) a physical therapist licensed under Chapter 453, Occupations Code;

(D) a physician assistant licensed under Chapter 204, Occupations Code; or

(E) a registered nurse, a vocational nurse, or an advanced practice nurse licensed under Chapter 301, Occupations Code.

(4) "Mental health services provider" means an individual, licensed or unlicensed, who performs or purports to perform mental health services, including a:

(A) licensed social worker as defined by Section 505.002, Occupations Code;

(B) chemical dependency counselor as defined by Section 504.001, Occupations Code;

(C) licensed professional counselor as defined by Section 503.002, Occupations Code;

(D) licensed marriage and family therapist as defined by Section 502.002, Occupations Code;

(E) member of the clergy;

(F) psychologist offering psychological services as defined by Section 501.003, Occupations Code; or

(G) special officer for mental health assignment certified under Section 1701.404, Occupations Code.

(5) "Employee of a facility" means a person who is an employee of a facility defined by Section 250.001, Health and Safety Code, or any other person who provides services for a facility for compensation, including a contract laborer.

(d) It is a defense to prosecution under Subsection (a)(2) that the conduct consisted of medical care for the child and did not include any contact between the anus or sexual organ of the child and the mouth, anus, or sexual organ of the actor or a third party.

(e) It is an affirmative defense to prosecution under Subsection (a)(2):

(1) that the actor was the spouse of the child at the time of the offense; or

(2) that:

(A) the actor was not more than three years older than the victim and at the time of the offense:

(i) was not required under Chapter 62, Code of Criminal Procedure, to register for life as a sex offender; or

(ii) was not a person who under Chapter 62, Code of Criminal Procedure, had a reportable conviction or adjudication for an offense under this section; and

(B) the victim:

(i) was a child of 14 years of age or older; and

(ii) was not a person whom the actor was prohibited from marrying or purporting to marry or with whom the actor was prohibited from living under the appearance of being married under Section 25.01.

(f) An offense under this section is a felony of the second degree, except that an offense under this section is a felony of the first degree if the victim was a person whom the actor was prohibited from marrying or purporting to marry or with whom the actor was prohibited from living under the appearance of being married under Section 25.01.

(8) the actor is a public servant who coerces the other person to submit or participate;

Statement issued Saturday, Jan. 5, 2013, by Patti Ohlendorf, UT-Austin Vice President for Legal Affairs:

Coach Bev Kearney informed The University of Texas at Austin today that she is resigning her position as head coach of the Women’s Track and Field program effective immediately. Coach Kearney also had advised the Austin American-Statesman of her decision.

Coach Kearney told the Austin American-Statesman that she had had an intimate consensual relationship beginning in 2002 with an adult, then a student-athlete in her program, and that the University had begun to review this relationship when it was reported by the former student-athlete in late October, 2012.

Neither the Intercollegiate Athletics administration nor the University administration had heard previously about this relationship. As soon as it was reported, Athletics notified the University President and the Vice President for Legal Affairs, who immediately began the review. Shortly after the review began, Coach Kearney was placed on paid administrative leave pending the outcome.

Based upon the review, the University does not believe that Coach Kearney had any similar relationships with student-athletes either before or after the reported relationship, which began about 10 1/2 years ago and ended at least about eight years ago. Coach Kearney is a good person and has been very important to the University. However, she made this terrible mistake and used unacceptably poor judgment in having this relationship.

The University determined that it no longer was appropriate for Coach Kearney to serve as head coach or to work directly with our student-athletes and was prepared to begin the termination process. This was discussed with Coach Kearney recently. The University told Coach Kearney that we cannot condone such an intimate relationship, including one that is consensual, between a head coach and a student-athlete. We told Coach Kearney such a relationship is unprofessional and crosses the line of trust placed in the head coach for all aspects of the athletic program and the best interests of the student-athletes on the team.
