I agree with all the posters regarding naming Pepsi & the race organizers in the lawsuit, that's ridiculous. While the defense (pepsi/etc.) would almost certainly win the case, they may just settle out of court anyway to avoid the costs & expense of lititgation. that stinks.
But... although I will get flamed for this, let me say that I think it's FINE to sue the parameds. What the hell, you are hired (and I assume receive cash) to provide medical support for an ATHLETIC event, and you don't bring a defrib? Those things are in McDonalds now, give me a break.
Ok, let me disclose that I'm a lawyer. And let me point out that while in America we can gripe about the frivolous lawsuits (I agree there are plenty), think about the alternative of living in a country WITHOUT a good civil court system. Why do you think the automobile industry makes a single saftey improvement that's not mandated by the gov? B/c they are afraid of lawsuits. What is ONE (of many) reason why the US medical system (though overpriced) is the best in the world? B/c hospitals & doctors know they will get their asses sued if they mess up (and they do all the time -- chopping off the left leg vs. right leg by mistake, leaving scalpels inside you post surgery, operating drunk, etc, you won't believe the crap they have been shown to do in court).
A result of this lawsuit will likely be that EVERY SINGLE PARASUPPORT for EVERY RACE in the future will have a defribulator. Most likely, this will save LIVES. Of course, by that time, no one will think to thank the lawyer who brought this lawsuit.
So don't be quite so 100% harsh towards the family & lawyers in this suit .. although I do hope Pepsi & the organizers are quickly dropped as defendants ...
