This is the justification ICE is using to remove him. Carrying a handgun and cash is not a crime.

One doesn’t need to commit a crime to be subject to an order of removal. Criminal proceedings are separate from immigration proceedings.
As a practical matter commission of crimes - including commonly occurring ones like DUI - alert immigration authorities as to targets for enforcement. Trying to diminish or explain whatever crimes this guy may have committed really isn’t relevant.
It seems the media doesn’t have the timeline nailed down yet. It appears Roberts gained additional education after Coppin State. So query at what point did his student visa expire? Query whether he had a different source of immigration authorization as well. All we know is Roberts was subject to a final order of removal in 2024.
My limited understanding of immigration law is that defenses to visa overstays are challenging. In many cases it is better to go back home and try to enter legally. But there often are extensive waiting periods. But not facing these issues means negative consequences. I am still puzzled why he did not retain counsel years before his removal order.
