Your argument seems to boil down to: he meant something other than what he said. Or, more specifically, he invited people to make inferences about his meaning.
Two problems:
1) What about intent? Who determines intent? What seems obvious to you is not so to others. That is the crux of the problem.
2) Interpretation. Related ro intent, but distinct, because meaning can be affected by culture. Is one interpretation valid over another because it is commonly accepted? To what degree does context matter?

I can't stand Kyrie Irving. He's the epitome of the mega-entitled a$wipe professional sportsperson that believes his athletic ability has transcended to intellectual ability and sadly has the platform to tell us all the way life is and how it should be lived. But thing is, he has a right to and I can change channels, close the app at any time. He also has a right to watch whatever garbage he wants to - you don't have to like it but it's his choice.
The suspension of Irving is preposterous. If exercising an amendment right in this country and not disavowing it based on content is seen as bringing the league into disrepute then that's troubling -

In some scenarios they can say pretty clearly actually. Kanye saying he was going to wake up and go “death con” 3 on Jewish people is obviously anti-Semitic. That’s not like what Chappelle was saying.
