You don't just get to wear any rank you want in the military. You have to qualify for the rank and for NCO positions you need to complete the relevant school/training. He qualified for the rank but skipped out on the school on order to get out of dodge before he had to deploy. None of this is disputed. He retired 2 years before his enlistment was up for the express purpose of getting out of going to Iraq.
