I don't buy that he was under a non-disparagement clause. There were obvious financial crimes committed at GST and Kyle would have protections under whistleblower laws that supersede any type of non-disparagement clause.
Besides, with how horrible GST was run I seriously doubt their contracts had any such clause.

Fraud? Theft? It was a start-up business that failed. It happens all the time. An entrepreneur finds investors and they decide it's worth the risk. There are no guarantees; it's called capitalism. And now we find out that MJ lost $2.2 million of his own money. That sounds like the opposite of theft.
We all want T&F to succeed and we want someone/something to replace the dinosaurs that run the Diamond League, but then when someone actually tries something new and fails, you jump on him. It doesn't exactly encourage the next guy to go out and try something new.

Kyle wasn't some kind of chief of staff to the CEO, and he wasn't on the board. He had defined responsibilities for a particular part of the business: the product. I've never heard of a company where someone from the products team would be dealing with investors, except to the extent that the investors are requesting the conversation as part of their due diligence. If you're on the product team, you're told what your budget is and what your objectives are. That's it.

Merber knew GST had no money, but kept on promising athletes they would get paid if they just kept racing.
That's extremely unethical and possibly even illegal depending on the type of contracts the athletes were on.
But he definitely knew what was going on at GST. He just didn't care. He was 100% a part of the scam.

There wasn't even drug testing at the meets so the excuse of waiting a for results of drug tests is a LIE.
