    They just can no longer make it obvious that they are admitting a student on the basis of being an ancestor of a former student.

    Similar to what real estate professionals and hiring managers did following affirmative action, admissions departments will just find and cite circumstantial merit based reasons for admitting such students when they're still essentially legacy admissions.

    The only rich kid legacy students who will legitimately get shut out are the bad unqualified HS students who don't play a sport.

    It's so overreaching.

    Because they offer services and accommodations to the public.

    Not to mention in many cases without the state they cease to be an entity in the first place.

    Seeking certain legal protections and status to operate from the state and then turning around and saying 'what's the states' interest here' is a little silly

    One important reason I think the state has an interest in banning donor and legacy admissions is that the state has a strong interest in supporting class mobility. Both donor and legacy admissions work against that interest. Since both public and private universities live off of the considerable largess of the state (tax breaks, grants, etc.) the state should use its levers to encourage it social goals. In this case, I would argue, the goal being class mobility.
