Breaking: FBI raiding Mar a Lardo!

I think the Special Master may reassure Trump that the attorney-client privileged documents have been properly culled out from all the Top Secret classified stuff he stole. There's probably a lot of REALLY bad stuff in the attorney-client documents, like discussions on whether to plead the Fifth, etc. Trump doesn't want the investigative Feds reading that stuff.

As to irreparable harm, I don't believe Judge Cannon was concerned with temporary lack of access to his documents, but rather that the Feds' privilege team will not adequately safeguard his interests. The Judge mentioned two instances, admitted to by the Feds, where the investigative team had access to attorney-client privileged materials.

I think the real reason that Judge Cannon wants the Special Master is that the Feds told her they had 520 pages of potentially attorney-client privileged material for her to review ex parte, under existing protocol, and she doesn't want to do it. I don't know if she is lazy, legitimately overworked, or strangely uninterested (who wouldn't want a glimpse of what Trump is saying to Giuliani?). But she wants the Special Master doing the review, not herself.

Much of the rest of the Order makes no sense. The whole executive privilege thing is bizarre. The Feds could attempt some kind of appeal, and get an actual legal mind looking at the issue, but I think the better strategy is just let the Special Master do his/her thing and then end up in three weeks right where they are now. The bottom line is they have the unidentified documents that Trump MAY claim "executive privilege" over. If Trump does, Judge Cannon can't give them back to Trump because they belong to the government. If he doesn't, they are just more documents subject to search warrant. He's never getting them back ever, under any legal theory. The whole executive privilege thing is a red herring that no one seems to have thought through. I think the Judge and Trump's lawyers are confusing/conflating the scope of attorney-client privilege and executive privilege.

Of course carmine9's conclusion that those records were the real target of the subpoena is absurd. The government had no way of knowing those documents would be there, and given the court rulings regarding Trump's tax returns, that information wouldn't have been a prime target. And the silly thing is that even if those records were the real target, Trump could have thwarted the government at any point by simply returning the documents that he shouldn't have had.

Again I will suggest you reassess your understanding of the word trigger/triggered in the context of this MB.
