My understanding of the Lawfare defense is that it is always available with respect to any publicly filed pleading that a person has not read.
Here is Trump's Complaint against Dow Jones d/b/a Wall Street Journal. The first striking thing to me is - why this? Hundreds of negative and unflattering articles get published about Trump every day, but this one really caught his eye as something he needed to attack, even though it raises the profile of the article AND puts significant burdens on Trump to actually prove facts that will be VERY difficult to prove. It's just a weird call he and his lawyers made to highlight this.
The Complaint is very thin on affirmative facts and allegations and it's primary allegation seems to be that the WSJ did not "attach" the Trump letter to Epstein (do media articles usually "attach" documents?) and that WSJ can't prove Trump had anything to do with it. Sure they can (not that they need to). It's in your best friend's compilation birthday book and has your signature on it and it was located during an FBI search of Epstein's house, and there is no evidence or reason that anyone would submit fake letters to the Epstein birthday book.
Trump also appears, although does not expressly say, to argue that he didn't "write" (i.e., hands-on type the letter), but the WSJ article never says he did. (As the Daily Wire points out, the prose is beyond Trump's sophistication and literacy level). WSJ uses "author" in the sense that Trump at least authorized and approved the letter (he signed it) even if he didn't actually conceive of the words and draw the t!ts himself. Basically Trump disputes, without any facts of his own, things that WSJ never said.
