Bottom line: The court said that L. James properly brought the case, that the case was properly conducted, and that Donald Trump et al. did indeed commit fraud. They also agreed that the ~1/2 billion penalty was excessive. After that, they're all over the map and the case will have to be heard by the Court of Appeals, the state's top court.
Ordinarily the CofA considers questions of law rather than debate the facts, so the most likely outcome of the case (which could well conclude after the Trump presidency, and almost certainly after the 2026 elections) is that it would be sent back down to the trial court to reconsider the penalty judgment.
There is zero chance this gets overturned so don’t get your panties too wet. Again, the chance is zero. Leticia, the fraud, James will now be defending herself. good luck.
No. If I've thrown a glass of water on the fire and you threw a bucket, I don't get to quibble about how you threw your bucket.
Moreover, if I've been kissing the a** of the arsonist, and LITERALLY blaming the fire on the owner, well.....
You provided the kindling, dared someone to start the fire and then danced around the fire like an idiot while throwing more wood onto the fire.
Idiots like you are the only reason there was a fire at all.
Got it, so you WOULD have put the extremely elderly Jimmy Carter on list of folks to blame about Ukraine. Puts the rest of us in pretty special company.
I was a few decades behind Nazi Germany and WWII, but I’m hoping that perhaps I was a little responsible for that, too.

Trump was held liable for fraud by this court decision. He cannot erase that since it was held up in appeal. The amount Trump has to pay will be determined by a new appeal as directed by this court decision.

And it got thrown in the trash where it always belonged. Now the hunter is the hunted. James will have her day in court, under the bright lites, in a real fraud case.

It’s VERY appropriate that the first “contribution” I’ve seen from you in a while was to strain to say that Putin is fine and Ukraine is (literally!) everyone else’s fault !!
Good that you’re saving your energy to only defend the most defensible!!
Seems the nutty $500 million fraud case againts Trump was appealed and the financial penalty thrown out
Very good, Newman! That’s probably your best post ever.
But I’d point out the case wasn’t held to be “nutty” however. In fact the New York appellate court affirmed the AG not only had authority to bring the fraud case against Trump and his businesses, but affirmed the factual findings of fraud, lies, biffage, and graft that we all know Trump has engaged in for decades. The fraud was pretty glaring in the opinion.
I assume Trump will appeal that, at least on behalf of Donald Jr. and Eric Dog. But I think the case might also go back to the trial court to recalibrate the disgorgement (“penalty”). That said, I skimmed the opinion and I couldn’t find anywhere that the appellate court was remanding back down to do that. Anyone know?
Eggs
The case was heard by an intermediate-level court. Both parties will want to move to NYS's highest court, the Court of Appeals. There was no majority opinion among the five appellate justices re disgorgement (except that it was too high), so no remand. Two were for a smaller disgorgement; two for just the injunction that governs the corp's operations from now on, and no disgorgement; and one outlier thought the whole case should have been dismissed. Whatever the Court of Appeals decides will, almost certainly, not take effect until President Trump is out of office; and the parties' appeal to the Court may not be heard for many months, very possibly after Election Day 2026.
And you are correct: The case was not "nutty." This court affirmed that the AG was correct in bringing the case under this statute, that fraud was demonstrated sufficiently, and that some of the lower court's penalties should stay in place during the appeal to the CofA.

Biden was consistently against Putin and the Gaza war. Trump's Putin BJ on Friday did more to escalate than end the war and he emasculated himself in the act. Objectively, Trump has made both wars worse.
Sorry but what are you saying? You think genocide Joe was against the Gaza war?
President Biden was pro-Israel. He put American troops in combat zones to support Israel’s military goals. Like most Americans, Biden wants Israel to triumph over Islamicalists who reject Christianity. Hindus reject Christianity too, and worship cows. You ever seen a cow live? Not much to worship, but somehow the Hindus manage. Jesus Christ, those cows are fat, dumb, malodorous and uglier than Ted Cruz’s wife. Ted Cruz should have got a wife with looks he could at least defend. That failure cost him an election. Now we’re stuck with a fraudster and Russian appeaser like Trump.

Sorry to everyone for all of the exclamation marks. I tend to use them a lot when I’m laughing at someone.
According to the New York Times, he said that DC was the most violent capital in the world. He lied - Port au Prince (Haiti), Cape Town (South Africa), and Caracas (Venezuela) are worse. Such great company to keep.

This decision locks in that Trump is guilty of fraud.

New York has three tiered court system, so Trump can still get the fraud findings reversed in a higher appeal. That is highly unlikely, however. The fraud is fat and obvious. I can’t imagine that even a Judge like Alito (Italian) would dispute it, if it ever got to SCOTUS.
Did the NY appellate court say that the case is remanded to recalculate the penalty? I can’t find that. But I only read the opinion through once. I’m an extremely busy man and I don’t have time for this stuff.

Thanks for the detailed response.
So because three judges opined there should be no disgorgement, that issue is finalized? Isn’t that saying that as a matter of law, disgorgement is not available in cases brought under this statute, and all the state can do is enjoin the fraudulent conduct?

This case is dead. James is going to continue to make a fool of herself in desperation to retain any dignity that is left, but there is none. She is toast as the Liberal lawfare dream gets flushed down the toilet, 1 X 1.
There used to be an attorney in Atlanta making crap up too, but forgot her name.

That’s not the only instance you admitted he lied, Spuds. You also admitted Trump lied when he submitted a false affidavit that he didn’t have any Top Secret documents in his bathroom next to the commode. And I really shouldn’t have tell you how disgusting it is storing anything in a bathroom next to a commode (aka “toilet” “crapper”). I mean, come on, man. Jesus Christ, it’s a fvcking commode.

Sure doesn’t seem dead, no matter which way the next court rules on disgorgement. Did you even read it? Do I need to include you on the previous list? Jesus Christ, aren’t you the guy who didn’t even know Bob Marley was black?
