But improper, or even illegal, does not automatically mean that it is a First Amendment violation. If I tell you to "shut up", that isn't a First Amendment violation. If the President tells you to "shut up", that isn't a First Amendment violation. If the FBI says 'careful about the information coming, we think it could be disinformation', that isn't a First Amendment violation. Can you read those words? I have concluded that you are, at least, obtuse. Several times I have acknowledged that the FBI's actions ranged from permissible, to improper, and potentially illegal, depending on what they actually conveyed and what they knew. But that doesn't make calling it a First Amendment violation correct. I never said that it wasn't a First Amendment violation so everything is OK, did I? So I didn't dwell only on "semantics". And it is more than semantics to get the charge wrong. If a court finds that Trump violated a statute regarding secret information it wouldn't make sense to say he was guilty of aggravated assault, or murder, or DUI. If you steal a car it wouldn't make sense to say that you defrauded the US Treasury.
