That's not a loophole, Magoo. It is well known that the Vice President has the sole authority to determine which electoral ballots/certificates are to be counted and which are not. That is established precedent. See 2020 election.
It remains to be seen what the current Vice President will decide on January 6, 2025. The Constitution will be vindicated by The People who have gathered, if necessary.
