The act he's using requires certain conditions to be met. Only people in the cult of stupid believe that those conditions have been met. Venezuela is not invading the United States.
If there's compelling evidence that EACH of these people are violent gang members, it should be trivial to deport them without resorting to the Alien Enemies Act and there would be no due process questions. The only reason Trump did not follow that approach is because there's no evidence that EACH of the people are a violent gang member.
Two days ago you didn't even know what the Alien Enemies Act was. Now you're convinced it's applicable because Trump says it is. You're in a cult and completely incapable of independent thought.
The act doesn't require an invasion. You're just repeating what other stupid people told you.
Read the actual act.
You're literally just repeating someone else's opinion.
Here's the text:
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That whenever there shall be
shall be -- meaning one of the following things MUST be true for the act to apply
a declared war between the United States and any foreign nation or government,
there is NOT a declared war between the United States and Venezuela. So, this doesn't apply.
or any invasion
the United States is not being invaded by Venezuela. So, this doesn't apply.
or predatory incursion
A predatory incursion means a smaller scale attack, like Benedict Arnold's 1781 Raid on Richmond or as Alexander Hamilton used the term in 1798: "Small, predatory incursions of the French..." This is also not happening, so doesn't apply.
shall be perpetrated, attempted, or threatened against the territory of the United States, by any foreign nation or government...
Tren de aragua is neither a nation nor a state.
So, now that I've clearly explain why the act that you couldn't even quote correctly two days ago doesn't apply, kindly go back your mommy's doublewide, bigot.
p.s. F*cking hysterical that you claim someone is "literally just repeating someone else's opinion" when every post you make is a verbatim copy of some Trump monkey's nonsense. You're in a cult and far too dumb to form your own opinions. No wonder you joined the military - you love being told what to think.

The Constitution refers to PEOPLE, not CITIZENS. Therefore, even people who entered the US illegally are entitled to Constitutional protections, including due process, while under the jurisdiction of the United States.
Glad to see you’re as uninformed about Constitutional Law as you are about everything else you post about.
You are a moron and a bigot.
The constitution was written for American citizens.
It begins "We the People of the United States..."
Not "We the People of the world or any *sshole who can get inside the borders.."
As always you're 100% wrong and completely unaware of it.
While there's lots the Supreme Court got wrong in their decision in this case, I just want to highlight the following sentence that even the conservative majority agreed to:
"It is well established that the Fifth Amendment entitles aliens to due process of law" in the context of removal proceedings.
This proves, once again, the TheBigotInTheRoom is a moron and the more it insists other people are wrong the more likely it is that it doesn't know what it's talking about.
So you quoted the wrong act (because you had no idea there were more than one) and it's taken me telling you 30 times before you realize it, and I'm the imbecile?
There were multiple related acts passed in the late 1700s. Only one didn't expire. It lays out specific situations where it's applicable, none of which are relevant to the current situation.
I provided the correct text from the correct act like 10 minutes after the first one a day you're still whining about it despite it being completely irrelevant.
Trump contends that Venezuela is releasing prisoners and sending them to the US.
If Maduro is doing this the act 100% applies to the current situation.
And you don't even know who Maduro is or where Venezuela is so we can skip the part where you mindlessly declare it's not happening.
So, a Trump-appointed federal judge just blocked deportations under the Alien Enemies Act.
"The review strongly supported the Petitioners’ position. In the significant majority of the records, the use of "invasion" and "predatory incursion" referred to an attack by military forces."
"Based on the plain, ordinary meaning of those terms ["invasion" and "predatory incursion"] in the late 1790’s, the Court concludes that the factual statements do not. The Proclamation makes no reference to and in no manner suggests that a threat exists of an organized, armed group of individuals entering the United States at the direction of Venezuela to conquer the country or assume control over a portion of the nation. Thus, the Proclamation’s language cannot be read as describing conduct that falls within the meaning of "invasion" for purposes of the AEA. As for "predatory incursion," the Proclamation does not describe an armed group of individuals entering the United States as an organized unit to attack a city, coastal town, or other defined geographical area, with the purpose of plundering or destroying property and lives."
Looks like Adolt was wrong again. Maybe he should stop posting about things he knows nothing about. Of course, that would mean he would have to stop posting entirely.
The Trump administration, U.S. District Judge Fernando Rodriguez, Jr., ruled, does not "possess the lawful authority under the (Alien Enemies Act), and based on the Proclamation, to detain Venezuelan aliens, transfer them wit...
And that’s something that only members of the stupid cult believe.
Looks like Maduro isn't in on it. Eddy the gullible idiot fell for another of Trump's lies and then called everyone who didn't believe him an imbecile.
A new memo from the U.S. Intelligence Council undercuts the White House's justification for imposing the Alien Enemies Act against Tren de Aragua gang members.
The release of the memo further undercuts the Trump administration’s rationale for using the Alien Enemies Act to deport scores of Venezuelans to a prison in El Salvador.
Gang members are not states or sovereign countries. We can’t be at declared war unless we pick a nation to be at war with.
All of Trumps bogus legal battles he will lose. The only question is will we have a country by then where it would matter. Because courts move slowwwwww.
"SECTION 1. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That whenever there shall be a declared war between the United States and any foreign nation or government, OR any invasion or predatory incursion shall be perpetrated, attempted, or threatened against the territory of the United States, by any foreign nation or government, and the President of the United States shall make public proclamation of the event, all natives, citizens, denizens, or subjects of the hostile nation or government, being males of the age of fourteen years and upwards, who shall be within the United States, and not actually naturalized, shall be liable to be apprehended, restrained, secured and removed, as alien enemies."
Venezuela is a hostile government.
Biden's own administration classified Tren de Argua as a Transnational Criminal Organization.
Another day. Another judge stating the obvious: Venezuela is NOT invading the United States.
This nation was founded on the “self-evident” truths “that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, [and] that among these are Life, Liberty and the pursuit of Happiness.” Declaration of Independence, at ¶ 2 (1776). Our Constitution embodies these truths, in a limited government of enumerated powers, in its system of checks and balances separating the executive, legislative and judicial branches, and in its guarantee that neither citizen nor alien be “deprived of life, liberty, or property, without due process of law.” U.S. Const. amend. V; see Plyler v. Doe, 457 U.S. 202, 210-12 (1982 (extending these protections to aliens).
The Court grants Petitioners’ motion for a preliminary injunction against removal. This Opinion gives the reasons. It discusses the whole of the AEA, and shows that the Presidential Proclamation, in mandating removal without due process, contradicts the AEA. The Opinion goes on to discuss the requirements of notice and hearing under both the AEA and the Constitution. And it concludes that since Respondents have not demonstrated the existence of a “war,” “invasion” or “predatory incursion,” the AEA was not validly invoked by the Presidential Proclamation.
If a President doesn’t have the right to throw murderers, and other criminals, out of our Country because a Radical Left Lunatic Judge wants to assume the role of President, then our Country is in very big trouble, and destined to fail!
They didn't just deport them, they imprisoned them. It's not a good idea to allow our government just to label anyone they want a "murderer", "terrorist" or "gang member" without proving that in court in order to deport and imprison them. That's a scary path to start walking down. It's also not cool that they are trying to sway public opinion in order to justify this and make people believe, again without proving it in court, that these people are criminals, they are using the court of public opinion, also not reliable and prone to mistakes and injustice. Stop falling for it. We should all be outraged the government is breaking laws and doing this!

Kilmar is free. Noyankee cries in his malt liquor.
A federal judge in Tennessee has ruled that a Salvadoran migrant at the heart of the debate over President Donald Trump’s border security policies must be released from jail while he awaits trial on human smuggling charges.
Implicate border czar Kamala Harris, Joseph Biden and the other demonrats who enabled crimes to occur. They knew that would be the inevitable result and turned a blind eye under the disgusting guise of inclusion to buy votes for themselves.

Implicate Trump for releasing 1500 violent terrorists on his first day back in office.

I didn’t read the entire thread and maybe this question has already been asked, but why wouldn’t an illegal immigrant who committed a murder, already be in prison? They would be prosecuted just like a citizen. Does Trump want to deny justice to the victims’ families by removing them from custody and deporting them?
Maybe he could deport them to a prison, but there’s no guarantee that they won’t be released after a year or two.
