The issue for the DOJ is whether Trump broke the law and in particular the criminal law. If the evidence convincingly says he did he cannot escape prosecution: the DOJ will be required to bring charges. For the DOJ to do otherwise would be in breach of its statutory role. Any "mea culpas" he might make cannot avoid that; they are effectively an admission of guilt. The only advantage for him would be towards a possible reduction in penalty. But we are left then with a former POTUS with a criminal conviction.
