As for the "Special Employee" -- imagine being so naive to think the rules around his tenure are sacrosanct and to be followed when everything else in this administration is up to interpretation or re-definition via executive order.
Perhaps it's not that anyone actually cares about the rules around his employment, but instead that he's failed at his primary task, or isn't wanted around anymore, or wants out because his businesses have suffered losses, or any other reason.
