If you believe ICE, they have clearly stated that many people did not have a criminal record, and several were not even in the US illegally. They just believed that they may potentially pose a threat in the future. This is from the ICE own statements.
You are clearly comfortable that suspicion from an ICE officer is sufficient ground for throwing a person in jail indefinitely without any due process, if they happen to have the wrong passport.
