Brutal Video of Police Officers Shoving an Elderly Man

Caveat: I am in my mid 60s and retired from a long career in law enforcement. I also have mostly liberal leanings - yes, this is possible.

This article made a couple of points that before reading it, that I had already thought about.

-There is not a simple single correct response, opinion, or solution.

- "... in a "continuum of force" that can begin with simple requests, then commands and then physical force, starting with grips, for someone not following police direction." (or in this case a light push back)

- advanced age does not mean the person is not a threat.

Four additional points:

- There was a designated 'medic' who was responsible and did attend to gentleman.

- I don't think, the two officers will ultimately be convicted of felony assault. If they are that conviction should and will be overturned on appeal. I base this belief on that it is unlikely that the the prosecution will be able to prove beyond a reasonable doubt 'intent' to cause bodily harm' as required under NY penal law 120.05 for a case "A" or class "B" felony. (Like you, I do not have all the 'facts' - this is just my opinion based on the 'known knowns'.

-The other 57 officers who 'resigned', - resigned from the response team, not from the department. Memberships on these types of teams are almost always voluntary.

-This was an unfortunate event - hindsight is often 20/20

I will close with, that is easy to judge from afar. Most people 'think' they know how they will respond a difficult complex or even dangerous situation. It is not that easy, folks.

Just the day before this incident, IN BUFFALO, an SUV sped into a crowd of police officers and ran over 2 - lucky it wasn't more. It's insane there's more outrage over a man getting pushed than there is about a guy trying to run over and kill 20 cops.

Let's not sugar coat these RIOTS (they are not protests). The police are under attack and they are RIGHT to protect themselves. That old guy could have had a gun or a knife in his pocket. 2 seconds of inaction could have led to a dead cop.

If we don't allow police to protect themselves, how they hell will they protect you?

As has been pointed out, bad cops like these are more destructive to policing than the old man protestor. By defending sh!tty cops you are doing the opposite of supporting police.

Anyone else think that was a pretty gentle shove and that guy have zero balance (i.e. a some what normal case for 70+ year olds). It was a back up push since we can't let you behind our lines versus a I am push you hard so you fall over. Seriously look at how little extension of the arms he gets. If the guy stumbles back 2 steps and catches his balance nobody would care. Stumble back 2 steps and crack your head open and it looks horrible. Makes you wonder if old people need to start wearing helmets in daily life.

If every cop who gave a similiar shove over the past couple weeks was charge, I am not sure how many of the guys i see on TV doing crowd control would still have a job. There seems to be a lot worse actions going on but those people just aren't ending up bleeding from the ear.

You're deflecting. Of course the driver was wrong, but unlike the driver, the cop is paid via taxpayer money and armed /w arsenal of weapons to protect people, not to beat up the elderly.

and nothing in the video suggests the old man was a legitimate threat. Dude is actually a peace activist. He might as well be a Jain. He's almost literally last guy we need to worry about.

There are protests and there are riots. These cops decked out like wanna-be special ops in Buffalo in the old man video...they were trying to break up a protest.

So the next time a cop stops you for speeding, should said cop shoot you? By your logic, he would only be two seconds from death. For all he knows you could have a gun or a knife.

The answer is of course no. The cops need to use discretion. Its a volunteer police force. They're not conscripted into it. The old-man-pusher cop assaulted that old man for no good reason.

JTFC, that's the highest quality version of the video that I have seen. I wish that old dude had been wearing the helmet rather than (allegedly) attempting to return it.

Does anyone know what he was discussing with the officers? How do we know he was trying to return the helmet? He wasn't holding the helmet out to the officers as he was approaching. I noticed it took some time after he hit the ground before he relinquished his grip on his phone, a sad statement of the times we live in.

I only found this official statement from his attorney:

The statement, released by attorney Kelly V. Zarcone, describes Gugino as a "longtime peaceful protester and human rights advocate." According to the release, he is in serious but stable condition and is "alert and oriented."

Gugino is asking for privacy but "appreciates all of the well wishes he has received and requests that any further protests continue to be peaceful."

except in the vast majority of countries similar to ours but with less aggressive police......this is not the case.

While colluding with loyalist paramilitaries they aided in the murder of countless civilians.

So what you are saying is that the Buffalo Police mistook a 75-year-old man for an SUV speeding at them. I find this unlikely.

If protecting me requires beating up 75 year old men....I don't want them protecting me.

It's sickening that you still don't say anything about the people running over cops, shooting cops, stabbing them. They beat up and dragged a female cop along the the street. You should be outraged at that, not this stupid little accident where they CLEARLY weren't trying to hurt the guy.
