Absolute insanity. What the hell does the law have to do with anything in this matter? It's not the law to allow Makwala to run at all, fit or not fit. It's a private institutions event and they decide who can and who cannot compete and who can and who can't enter the stadium. They can ban Rojo from entering for simply being an annoying know-it-all.
Actually, you're the one who seems confused. The IAAF may be a private organization, but their authority is still constrained by law, including its charter and its many contracts. Just one example: They didn't want to let Caster Semenya compete without being treated, but the CAS said that was unlawful. The question everyone is asking is what was the source of authority that authorized them to make this particular decision because they can't hide behind British law. I don't practice sports law other than antitrust, so I don't know the answer, but it's a serious question.
No, CAS ruled that IAAF can't say Semenya isn't a woman because of her testosterone levels. That's entirely different.
The IAAF can say you aren't allowed in the final because you didn't run under 20.3 in the 200m. It's totally arbitrary and up to them

One would be that of lifeguards at swimming pools. It's not law, but if your pool doesn't have them and someone drowns then you will certainly be sued the shit out of for ignoring the guidelines set out by the experts (RLSS). More than be sued, you'll face corporate manslaughter charges and jail, because of failing to follow guidelines which are not law.
You will certainly lose. There is no point standing in court and saying "oh it's not law to have lifeguards so leave me alone". They will say you ignored the experts and are responsible.
Likewise you (IAAF) can't ignore the guidelines and specific recommendations by Public Health UK (the hotel didn't either) because if tons of athletes have to drop out due to sickness because the outbreak of illness wasn't contained then the IAAF will lose in court when they get sued.

The facts are, that all teams were advised on the 6th, that due to the norovirus outbreak, would athletes with vomiting and/or diarhea symptoms be quarantined for 48 hours. Makwala vomited in the callroom and was subject to a clinical diagnosis. A test would be fairly irrelevant, since the process time is roughly the same as the quarantine. To the doctor did he claim to have vomited for 18 hours (noted in the file). Had he withdrawn himself without adequate reason, would he not be eligible in any other events (the 400 or the 4x400. Rule 142.4
There is no cover up. There might be sick athletes, that competed prior to the team letter and the quarantine order on the 6th, and there might have been athletes that didn't disclose symptoms prior to competing, but in essence did IAAF react exactly as they said they would.

Do you have any clue how contagious noroviruses are? Entire cruise ships and hotels are taken out in days by these things. The infectious dynamics, like the diarrhea, are explosive. Dozens of athletes could easily be infected. The whole fvcking meet could be sunk. Then how would BBC and LetsRun be reporting on this? With great criticism and sanctimony toward the IAAF, that's how.
Assuming the meet couldn't be postponed 1-2 days, excluding probable cases for the transmissible period was the right call.
