“Entrenched racial inequality remains a reality today,” Sotomayor said. “That is true for society writ large and, more specifically, for Harvard and the University of North Carolina (UNC), two institutions with a long history of racial exclusion.”
“Ignoring race will not equalize a society that is racially unequal,” she continued. “What was true in the 1860s, and again in 1954, is true today: Equality requires acknowledgment of inequality.”
Sotomayor also noted that her conservative colleagues relied on arguments found in the dissenting opinions of previous rulings, suggesting that these “lost arguments” are not grounds for overturning precedent and further degrade confidence in the court.
“When proponents of those arguments, greater now in number on the Court, return to fight old battles anew, it betrays an unrestrained disregard for precedent,” the justice said.
“It fosters the People’s suspicions that ‘bedrock principles are founded … in the proclivities of individuals’ on this Court, not in the law, and it degrades ‘the integrity of our constitutional system of government,’” she added.
Well said. Whites have gained a 10-mile advantage in the marathon because we decided at the race start that blacks were ineligible. We've now had a rethink and decided blacks can join the race on equal terms, which means they can now start the race at mile 0 instead of mile 10.
Anyone who thinks they should start at mile 10 is an anti-white racist, apparently.
Actually, Asians are winning the race, and they started further back.
People are INDIVIDUALS. Not every white person is born into generational wealth. Not every black person is poor because of slavery.
Why should a privileged black person like 458777 get preferential treatment over a poor white person or poor asian?
If 458777 and his parents are so privileged, then you would have loved being born black in America before 1980! You would have committed suicide if you were born black in America in the 1970's or before. Suicide...isnt that what you white males do the most...more than homicide.
He has said both of his parents are college educated.
Being born into a 2 parent home with 2 college educated parents is a position of privilege.
The lily white liberals who own you have aborted MILLIONS of black babies. Your excitement over white suicide should be kept in perspective.

Asians are hurt far more than whites (who aren't really hurt all that much from AA).
Did Asians get a 20-mile advantage somehow?
"Asians" might not have gotten a head start but many were not subjected to the same prejudices that other groups endured. Also, Asians are not a monolithic group. Why are so many here grouping Asians altogether? Some groups that immigrated here came with wealth and are just as privileged as any white student.
affirmative action made sense in the 60s and 70s when we were still coming out of the civil rights movement, but in 2023 it's become more of a crutch to minorities than a step up, at least in my opinion.

This sort of ignorant thinking is the problem...
People are INDIVIDUALS. Not every white person is born into generational wealth. Not every black person is poor because of slavery.

Statistically speaking black families are among the poorest in the nation and consequently have more limited opportunities with education. There are relatively few middle class black families although of course they exist. Affirmative action is a blunt tool but that doesn't make it worthless.
Low-income white people are still not going to be accepted now that affirmative action is no more. If you wanted to improve the odds of low-income white people you needed to argue for the affirmative action system to be expanded to include them, but seeing as affirmative action has been abolished, that's not going to happen.
Sort of true but not exactly. Even East and South Asians born to uneducated, non-professional parents on average are more successful than their peers of other races. A variety of explanations have been proposed, such as strong family structures, connections via social groups, churches etc. I think this is like true of African immigrants also. But Asian success in the US is definitely skewed by the fact that their parents on average are more highly educated, and motivated to help their children succeed (otherwise why would they bother moving?)
Legacies tend to be qualified. Athletes are filling a specific role - not based on any protected characteristics. On the other hand, affirmative action literally discriminates based on race.
If they are qualified then remove legacy admissions preference.
"This is a great day for America. People with extraordinary ability and everything else necessary for success, including future greatness for our Country, are finally being rewarded. This is the ruling everyone was waiting and hoping for and the result was amazing. It will also keep us competitive with the rest of the world. Our greatest minds must be cherished and that’s what this wonderful day has brought. We’re going back to all merit-based—and that’s the way it should be!"

You do know that tons of blacks were denied admission into their state universities because they banned black people. Tons of the these people are alive today. Just because they were forced to attend a school in the North and graduate doesn't give them privilege. How about you ask any black person who fought for civil rights from 1950's through the 1980's if they feel priviledged. For a white guy you certainly make a lot of prejudiced biased and incorrect assumptions about black people.
We can all tell you really don't know any black people and none have never invited you to their home for a meal or vice versa. You just spew repeated nonsense about black people that you have heard for generations, which most likely started within your own household from your parents and grandparents.
Also it funny you mention abortion and blacks, like you actually give a damn about black people at all. But are quick to say stop having babies and get a job. I thought according to your kind, all blacks people do is abort, but yet we have all these babies? You folks can't even get your disparaging lies together. Carry on with the suicides, which outnumber all types of homicides. And since you outlawed abortions then blacks will continue to grow and you will even more quickly become the minority. As they say, you better hope black people don't treat you like you treated them for 404 years.
Actually this is a common misconception; in reality, legacies are among the strongest applicants in the pool for the Ivies and other top academic programs because they have two big advantages.
One, genetics, someone whose parent or both parents were smart enough to be admitted to Harvard are on average going to have a similar level of intelligence.
Genetics is only one factor in academic success the other is resources and environment. Ivy graduates tend to have higher salaries and more resources than the general population and in this way legacies also have an advantage. They are more likely to live in top school districts or send their children to private schools and provide them tutoring than the general population.
The fact is all top schools reject more than half of their legacy applicants. Legacies have a higher overall acceptance rate as they are generally more qualified, have better grades, test scores etc. If you speak to anyone in admissions, (like my wife) they will tell you the same thing. Sure on the margins there may be some legacies who wouldn't have gotten in otherwise but far fewer than a generation ago. There are also a few outliers say if an alumni is a big donor but at most schools that will only get so much of an advantage. Harvard isn't going to take someone with a 2.9 GPA and 1000 SAT score just because their parent donated a lot of money, just as that wouldn't get even the fastest high school runner in either.
Also if you want to get technical on what group gets the biggest boost research has been published in that regard. Espenshade and Radford examined a group of the most selective private colleges, they determined black applicants received 310 point boost, Hispanics 130, and a there was a 140-point penalty for Asians. Other analyses sighted by the plaintiffs in the Supreme Course case have shown that, within a given selective school, blacks tend to have much lower academic credentials than whites—frequently in the range of 200 SAT points. Legacy whites have higher SAT scores than the general white applicant pool and the same is true of non white legacies.
There are certainly lots of unqualified or lesser qualified legacy applicants to Harvard and other top schools. however, with a few exceptions, these are not the legacies that are getting admitted.

Asians are not a monolithic group, there are plenty of poor Asian communities. However, the majority of Asian-American families immigrated to the US in the 20th century which was a time when the US began to implement strict requirements on who could arrive (basically you have to have money or skills).
The average Asian immigrant to the US is wealthier than the an average black or white citizen because that is the criteria the immigration service uses to select which people can settle. No such system existed when the majority of black or white Americans arrived.
