Is it wrong that I refuse to work passed the time I'm scheduled to work?

You are getting paid, just not getting paid overtime which would be 1.5x your normal wage

Clock your time. You will get paid for it.

OP, we are confused by what you mean when you are not paid "overtime."

Are you getting paid for every hour you work? Everyone agrees you should be paid for every hour you work at an hourly job like working at a bike shop, including hours past your regular stop time. At a job like that, no one expects you to work for free.

Or, is your issue that you are not paid higher hourly wage (e.g. time and a half) for extra hours past your normal stop time? I think everyone also agrees that you don't get time and a half unless you've worked at least 40 hours that week.

A separate issue, assuming you are getting paid, is whether you personally have time to work past your normal stop time. That's not a wage issue. That's a boss/quality of life issue. If you need to go home to study, that seems reasonable. It also seems reasonable that you would stay late sometimes to get the job done, again, assuming you are paid. You just have to work that out with your manager/boss.

Years ago I was in a similar situation at a unionized drug store. I brought it up to the manager and he had no choice but to pay for time worked. I think he was just hoping that I wasn't adding up the hours myself.

It's called job creep and it's prevalent. Each situation is unique, but you're probably not wrong.

Just going to throw it out there again that if he is scheduled to work until "close" that he isn't supposed to leave at 8:30 when the the shop closes. He is supposed to do all activities involved with closing shop for the day (cleaning, taking out the trash, cashing out registers, doing inventory, etc) before heading home.

Actually, if you hit 30 hours a week then a bunch of Obamacare stuff kicks in and they have to give you benefits. Technically a 30 hour worker is considered full time for Obamacare purposes.

This is likely why they are only recording up to 25 hours. Has nothing to do with overtime.

Isn't 25 hours a pretty typical "part time" load?

If an employee averages 30 hours or more per week over the year then the employer has to note whether or not the employee was offered medical. There may or may not be fines if not.

And as a high school student he is probably covered by his parents so the employer would not have to provide coverage.

I don't know why he stopped working but stayed there. Just leave of you are not going to work.

If he closes 2x a week and works 2hrs over each time, he is coming VERY close to 30 hours and qualifying for benefits. His employer does not want that to happen. So he is being told to falsify his time to stay at 25 hours, safely under the limit.

It doesn't matter if he is covered by his parents or not. He still becomes eligible if he is averaging 30 hrs a week....he doesn't have to take it. The employer still has to do all the paperwork which they do not want to do.

It has nothing to do with overtime because he will not come close to 40 hours...

This is typical in the new economy. Part time jobs are capped at 25-28 hours so Obamacare does not come into play.

You should be paid for that time. It is a clear violation of labor laws.

12:30-close 3 days a week = ~25 hours, or, as he's complaining about, more like 29.

You don't earn time-and-a-half for 29 hours.

However, 9:45 is a long shift for anyone, especially a HS student. If it's too long for you, tell your managers and perhaps they'll change your schedule to accommodate you.

To simply stop working at 8:30 while still getting paid?--yeah, makes you a poor employee.

The reason this likely has nothing to do with ACA (Obamacare) is that the Employer Mandate applies to employers with at least 50 full-time employees (or if you add up the part-timers hours to make full-time). Assuming this is a local bike shop or even a small chain, good chance they do not employ anywhere close to 50 full-time employees (or the equivalent) so the ACA discussion is irrelevant.

Um. He's not being told to keep his hours low.

He's being told to work more.

He refuses to work more because he thinks he won't be paid for the additional work. (pretty sure he is wrong about that)

You seem to be insinuating that he is being told to work off the books to keep his hours under 30.

That notion is coming out of nowhere.

if he is 14 or 15 or 16 even, there may be laws prohibiting him from working over 25 hours
