To summarize: 1) The judge ruled out murder before lunch. 2) After lunch, she 'said she was "not persuaded" that a reasonable person Osar's background/ abilities would have fired the shots that killed Reeva meaning he's likely to be guilty of culpable homicide. Shen then called it a day even though she'd been back from lunch for less than an hour.

I can understand the breaks if she wants to make sure on something. But calling it a day shortly after lunch does seem to be cruel and unusual punishment.

That being said, read the first BBC article on page 1 where the commentators went minute by minutes telling you what the judge was saying. She was getting high praise for that and it's clear she's thought a lot about the case:

Culpable homicide which he's likely getting has a maximum of 15 years in prison and minimum of 5 years. They suggest 7 to 10 is likely. Weirdly, one can get 'up to 15 years' for simply having the illegal ammunition that Oscar had. It's also come out at trial that he's twice discharged a firearm in public which is punishable with up to 5 years per charge.

Thus it seems to me there is no way he gets less than 10 years in the slammer.

Does anyone know if the sentences can be stacked on top of each other? That's the only question I have really. I've googled and can't figure it out. He's likely to get 10-15 years unless they can somehow stack the sentences on top of each other.

Humm, OscarP either:

1) goes into a rage and shots his girlfriend.

or

2) goes into a panic and shots into a bathroom.

Sjbeale, does not agree with a decision of a judge and wants either kill her, beat or to a pulp, or at the very least to punch her in the face, and he somehow thinks he is any different than OscarP. People who respond with rage and violence when they don't get their way are ticking time bombs and need help.

Yeah - I kinda laid it all out yesterday in my prediction thread. Including the concurrent part. And I predicted he would get culpable homicide and the lesser charges and be sentenced to 15 years. So, I don't find this unbelievable at all. If you can afford a great lawyer you seldom get convicted of the highest charge unless you were caught on video or had eyewitnesses (not ear witnesses).

Not sure why any American should be surprised... every year, thousands of gun owners here leave their weapon unlocked, loaded and accessible. Either a young child or mentally ill person grabs it and shoots themselves or someone else or someone steals it to commit a crime. Guess what, the gun owner is never charged for being irresposnible.. so what's the big fuss on this one? This going to happen in any place that's has a wild wild west culture. Nothing surprising here.. he'll get a couple years sentence at most and will get out in months for good behavior. EOT

Agreed. There was probably a shred of doubt for murder/homicide charges and if convicted of that, OP would have appealed and case dragged on and OP out on bail shooting who knows how many people for years.

Other posters shouldn't yet get their knickers in a knot, this judge is tough. She will nail him for max sentence, which is really what we all want: OP in jail wide eyed and defenceless in the showers.

Judge has given a serial rapist 252 years in prison, compared to America's sometimes unfairly lightweight sentences.
