rsbones you don't get it. you seem to be the type that if you break a fingernail you would sue someone about it. if you caught a cold you would sue the all of the sick people at work for not staying home and getting you sick. if a bird pooped on your car you would sue the parking lot owner, or the city that owned the street.
afterall, you are not responsible for taking care of yourself. someone else is.
You've assumed wrong. I'm all for taking care of ourselves. I'm even more for not causing harm to other people and then pretending like they should just suck it up and pay for the damage themselves.
In this case, a runner or group of runners or a guide for a blind guy or someone other than this lady, caused this lady to get hurt. She was minding her own business and they hit her from behind (the reason she named so many defendants is she likely doesn't know exactly who hit her and who is at fault and so you name them all and let the finger pointing begin until they identify who is responsible).
Why should she pay her own medical bills? Why shouldn't she be "made whole" for the time away from 100% that she spent? We can argue about the amounts, but I can't believe anyone argues against the principle that people have to pay for damage that they cause.
Like I said, if she can't prove damages, then the suit will be thrown out. But if she was damaged by another human being, then that human being has a responsibility to make up for it.
